Could you possibly try using the web version if you're using the app? You can do this at Xbox Cloud Gaming (Beta) on  Xbox.com

Also, could you try using another wifi connection to see if it helps resolve your issue?

Also, please check that your region is on the list of supported regions for Cloud Gaming you can check this at https://www.xbox.com/en-US/regions

“Requests are made within 14 days of the purchase date
Requests are for games in which you haven’t accumulated a significant amount of play time”

Additionally, there are other factors that they take into account once they receive your refund request. As they mentioned in the same article, “be aware that submitting a request doesn’t guarantee a refund, especially if it doesn’t meet the above criteria.”

However, when a refund request is denied, you can appeal the decision by replying to the email Microsoft sent you. If you’re not able to reply, or you didn’t receive the email, you can try asking for a refund by submitting the form below:

For the first time anyone who buys faulty goods is entitled to a full refund for up to 30 days after the purchase. Before the change, consumers were only entitled to refunds for a "reasonable time".

Of particular interest to gamers is increased protection for people who buy digital content. If digital goods are faulty, consumers are entitled to a full refund, or a replacement. This is the first time consumers have had clear legal rights for digital content. Money back or take it further.

Please, open the Microsoft Store by typing "Store" on your Windows Search Bar.

On the Microsoft Store, type your game name: Example "Fallout 76".

Load the game page and click on "Install".

This should work.

In case you still have issues, reset the Microsoft Store first and repeat the previous process.

To Reset the Store, Press the Windows Key + R > Type WSReset.exe and press Enter.
