When the "Enforcement Team" get it wrong

The difference in the quality of the interactions between Smwutches and I and those between xHAZMAT RADIOx, ngocphi and I are starkly obvious. As a paying customer with genuine concerns, I expect the former from an Ambassador; not the latter.

    Thank you.

giving you correct answers are not disrespectful only you have been

Accepting an answer and throwing insults back is not acceptable also part of why your other thread was locked

I am sure that the Ambassador Moderator will be interested to hear your explanations. I am not.

I know how both of you made me feel, and it was unpleasant and totally unacceptable.

Only Smwutches was able to help me reach the core issue, without the use of emotional, condescending, wise guy remarks. He didn't try to shut me up or put me down with threatening and insulting undertones.

I expect satisfaction here. I have absolutely no intention of letting this go.

I will comment no further, and any other comments will simply be unread and reported.

    noone threatened or insulted you

There is large differences between insulting and not agreeing with you.you have been told the same answer as swmutches and yes you been told you are accountable to the terms of use and it doesnt matter you did enter a moded lobby

You are the only one who is threatening anything and no you do have to answer to the terms of use

Which I might remind you to read the terms of use

"But the enforcement team got it wrong."
    - It's not a matter of intent. You either did or did not violate the code of conduct. And there was enough for the Xbox Enforcement Team to make the appropriate decision

    - Consider it a learning experience

"I consider the remarks, tones and attitudes of both "xHAZMATRADIOx" and "ngocphi" to be disrespectful, insulting and quite simply appalling."

    - You consider my remarks offensive. I find that interesting based on everything you've stated.

    - You're welcome to hit that "Report" button and the info will go to the Ambassador Moderator of the forums for review. Please click that button

    - Just so you and I are on the same page, here are a few of the highlights from your other post that has since been locked

    - Quotes from Alaria below from the titled post "When the "Enforcement Team" get it wrong"

the customer is right, completely disconnected from other services, so arrogant that they believe that there is no one out there smarter than them. They act as judge, jury and executioner, and if you don't like it... tough.

When Batman and Robin from the Enforcement Team get it wrong, and I can assure them that got it wrong here,

Microsoft: show us the faces behind the Enforcement team. Give us names, email addresses and direct telephone numbers. When they become accountable to the customers, then we might see some justice.

I've never said anything like what you've stated to any other member here. I've never made demands of someone's personal info or made belittling or defaming remarks. You're disrespectful to the people here on the forums and towards Xbox as a whole.

Anyone that tries to help on the forums in some capacity is trying to give the person posting the question relevant info.

If anything, you could at least apologize to ngocphi and Smwutches and just say "Thanks for the info. I understand."

You knew he was cheating in the game and then was worried about joining his session. That should have been enough for you to not join, even if his session wasn't modded.
Yes, I knew that he had cheated in the previous unmodded game. I imagine all of the other players did, too. His score was well over 30 kills. Are all the other players guilty then? Do they also deserve a ban?

I joined the session in progress for revenge, hoping that he would not be cheating this time. I believed that he was challenging me to fight by the rules. I hesitated at first, then decided to go for it. Why would I enter the session if I thought he was
going to be invisible again? It makes no sense. You can't kill what you can't see, even I know that, and I have no mods to play him at his own game. It would have been pointless. He was not invisible in the second session. I saw him clearly. If he had been
invisible again, I would have left immediately.

    Use unauthorized hardware or software
    Never done that.

Make unauthorized modifications to your account profile or its contents (e.g., tenure, Avatar, game saves, Gamerscore, achievements)
    Never done that.

Intentionally play with someone who is using unauthorized software or methods <---- Joining his session is enough to violate this.
There was never any "intention". To have "intention" I would have had to have known that this particular session I was joining was modded, or that the player was going to continue to use unauthorised software or methods. That was not the case. There was
no way of knowing that the session was modded, no way of knowing that he was going to continue cheating. Thus how could I have had "intention"? I wasn't even in the session long enough to realise that it was modded.

So I joined this session with the intention and the desire to take him on on equal terms; the session is modded and I don't know it; he uses a mod or something to reduce my MW3 rank from the highest to the lowest and does God knows what to my profile... and
I get a three-month ban, my MW3 rank is wiped out, and my gamerscore reset to zero. Does that sound fair to you?

How does the Enforcement team prove "intention"? If, just by playing in a session where someone is cheating, and you continue to play, in practice this could result in all of the other innocent players being banned. This is a ridiculous situation.

Sorry, but this needs to be rectified.

You also do have a second thread still open.
OK, I'll check that. I couldn't reply on the other thread and there was a padlock.

Phone/chat support do not handle enforcement issues.
I understand that. I contacted Microsoft Support to inform them of the incident and we tried to obtain my previous profile. It was a few weeks later that the Enforcement Team got involved.

you did something to violate the code of conduct, namely, joining a modded session.
How would I have known that the session was modded? I entered through "join session in progress". Where does it tell me that the session is modded? To my mind, it doesn't. Please correct me if I am wrong. I wasn't in the game long enough to even realise
that it was modded. For reference, the player was cheating during the previous, normal, unmodded game. Why would I expect the next session to be any different?

Gamerscore resets are permanent. If you want to re-earn those achievements, you would have to start a new account. Otherwise you will only be able to earn achievements that were not part of your reset.
This initially sounded like a solution, but now I'm not so sure. Are you saying that they are gone forever if I continue with my exisiting account? Double-whammy? Ouch.
