When the "Enforcement Team" get it wrong... Continued

My last article was treated with disrepect and distain, and so called Ambassadors then locked it so I could no longer reply.

    Here is my reply:

    1. I never entered a boosted game. I "joined a session in progress" with no indication that it was a boosted game. When the incident occured I immediately contacted Microsoft Support who opened a case. Would a cheat do that?

    2. There is a big difference between "protecting identity" and creating an "autonomous, anonymous authority with powers to act as judge, jury and executioner" with no accountability to playing and paying customers. I would also like to believe that the Enforcement
Team acts in good faith, but they certainly got it wrong in my case, as God is my witness.

    3. The Enforcement Team arrogantly carry on as if there is no one smarter than them out there. Victims and cheats are being caught in the same net, and the reality is that the Enforcement Team can not distinguish between the two.

Wake up and listen instead of branding life-long honourable players as cheats and liars.

My legitmate, hard-earned gamerscore of 7005 points - will that be restored?

    :)

  3. When "The Enforcement Team" Get It Wrong

Not only will the Xbox Enforcement Team not do what you ask here, they won't even read it.

The Xbox Enforcement Team does not use these forums. For information about your account suspensions or bans sign in at this site with your account at https://enforcement.xbox.com

Only an actual person from the Xbox Live Enforcement Team can impose or remove a suspension or ban on the account. - "Despite what some may claim, Xbox Live Policy & Enforcement Team will never ever ban anyone “for no reason”. Suspensions always occur as
a result of a specific Code of Conduct violation." Xbox Enforcement | How Do I

If you want to contact the Xbox Live Policy & Enforcement Team you can file a Case Review - You can't file a Case Review if the suspension is less than 24 hours or you failed the questionnaire. - Note: Currently, Xbox device bans are not eligible for
Case Review. Case Review - Xbox Enforcement | How Do I

The Xbox Enforcement Team also conducts reactive investigations. Many of these investigations are triggered by player complaints.

The Code of Conduct has no statute of limitations, and users may be enforced upon at any time for past offenses.

    - Your last post was nothing but disrespectful towards other players and other people in the Xbox Community and hateful towards Xbox and Microsoft

The post was informative; a true account of what had happened. Please tell me which players I disrespected? The one who runs around invisible and caused me all this grief? OK. What happened to him, by the way? What about the disrespect that you are showing
    me?

I would not have had to "spam" as you call it, if you hadn't closed my discussion so rudely and quickly.

"Hateful"? Angry and frustrated at the injustice and the impossibility of recovering the situation, yes. Hateful, no. You're way off.

Correct. I pay. Please don't forget that. I have always abided by the rules. My history was virgin-white and then suddenly I was treated like a cheat and a liar for something that I did not do. I was open with Microsoft right from the very
start. I chatted with Microsoft support and Activision immediately after the incident. I had nothing to hide. I had been a victim of abuse by another player and I asked for support. All I received in return was a ban and my gamerscore reduced to zero.

I had acheived an acceptable gamerscore of 7005, prestige 3, and spent hours achieving the top ranks of MW3. Why would I cheat now? What could possibly be gained? I was already where I wanted to be. It makes no sense.

Again, correct. I pay for a service. I don't expect to be a victim of it.

Absolutely. In business, when a company refuses to even pretend to listen or consider a loyal customer's genuine concerns and issues, then that company loses the customer and the revenue.

Your responses contain many menacing under-tones. Being held responsible for what we say and what we do works both ways, by the way.

Finally, My gamerscore of 7005... Any solutions?

Phone/chat support do not handle enforcement issues. So even though you may have reported the issue to them, they ultimately have no say in enforcement issues. The enforcement team did investigate the issue, not once but twice since you submitted a case
review, and still found that you did something to violate the code of conduct, namely, joining a modded session. Anytime something seems suspicious you should just leave it alone.

Ambassadors do not have the ability to lock threads. That would have been done by a forum mod. You also do have a second thread still open.

Gamerscore resets are permanent. If you want to re-earn those achievements, you would have to start a new account. Otherwise you will only be able to earn achievements that were not part of your reset.

OK, I'll check that. I couldn't reply on the other thread and there was a padlock.

I understand that. I contacted Microsoft Support to inform them of the incident and we tried to obtain my previous profile. It was a few weeks later that the Enforcement Team got involved.

How would I have known that the session was modded? I entered through "join session in progress". Where does it tell me that the session is modded? To my mind, it doesn't. Please correct me if I am wrong. I wasn't in the game long enough to even realise
that it was modded. For reference, the player was cheating during the previous, normal, unmodded game. Why would I expect the next session to be any different?

This initially sounded like a solution, but now I'm not so sure. Are you saying that they are gone forever if I continue with my exisiting account? Double-whammy? Ouch.

You knew he was cheating in the game and then was worried about joining his session. That should have been enough for you to not join, even if his session wasn't modded. Per the code of conduct:

Don’t cheat or tamper. For example, don't:

    • Use unauthorized hardware or software
    • Exploit game vulnerabilities or glitches
    • Make unauthorized modifications to your account profile or its contents (e.g., tenure, Avatar, game saves, Gamerscore, achievements)
    • Intentionally play with someone who is using unauthorized software or methods <---- Joining his session is enough to violate this.

You can still earn achievements on your account to get your gamerscore back up, but you can never re-earn the achievements that were reset. Those are gone forever on that account.

Yes, I knew that he had cheated in the previous unmodded game. I imagine all of the other players did, too. His score was well over 30 kills. Are all the other players guilty then? Do they also deserve a ban?

I joined the session in progress for revenge, hoping that he would not be cheating this time. I believed that he was challenging me to fight by the rules. I hesitated at first, then decided to go for it. Why would I enter the session if I thought he was
going to be invisible again? It makes no sense. You can't kill what you can't see, even I know that, and I have no mods to play him at his own game. It would have been pointless. He was not invisible in the second session. I saw him clearly. If he had been
invisible again, I would have left immediately.

    Never done that.

    Never done that.

There was never any "intention". To have "intention" I would have had to have known that this particular session I was joining was modded, or that the player was going to continue to use unauthorised software or methods. That was not the case. There was
no way of knowing that the session was modded, no way of knowing that he was going to continue cheating. Thus how could I have had "intention"? I wasn't even in the session long enough to realise that it was modded.

So I joined this session with the intention and the desire to take him on on equal terms; the session is modded and I don't know it; he uses a mod or something to reduce my MW3 rank from the highest to the lowest and does God knows what to my profile... and
I get a three-month ban, my MW3 rank is wiped out, and my gamerscore reset to zero. Does that sound fair to you?

How does the Enforcement team prove "intention"? If, just by playing in a session where someone is cheating, and you continue to play, in practice this could result in all of the other innocent players being banned. This is a ridiculous situation.

Sorry, but this needs to be rectified.

You joined his session already knowing he was cheating. From the enforcement side it would look like you intended to play with him willingly.

The enforcement team already upheld their decision. There is nothing else that can be done.

When the "Enforcement Team" get it wrong... Continued

I understand your point, Smwutches, and I appreciate your help: I have a better insight now as to what actually happened.

But the enforcement team got it wrong. I have stated my case regarding intentionality above, and I stand by it as a true and honest account of what actually happened. Their decision regarding my intention was wrong: it really is as simple as that. The fact
that we can effectively do nothing about it is intolerable. If they had been more precise and specific about the reasons for my ban, I could have answered more specifically.

The moral of this story seems to be that if you fall victim to a cheat/modder then don't expect any support from Microsoft, and especially not from the Enforcement Team. In their eyes, you are as guilty as the cheat/modder (if, subjectively, they decide
you had intention) and you can expect a ban and have your gamerscore wiped out.

I accept that nothing else can be done now about my case - my gamerscore has gone forever it would seem, but something should be done about this. Microsoft simply can't put cheats/modders in the same basket as honest gamers. It is inacceptable. This changes
playing online with Xbox Live from a "fun" experience to a "risky" one. Please advise on how and where I can escalate this issue for further discussion and consideration.

So true. I consider the remarks, tones and attitudes of both "xHAZMATRADIOx" and "ngocphi" to be disrespectful, insulting and quite simply appalling. Please advise on how and where I can make an official complaint about both. They should
know that I have saved this discussion on my PC as a pdf file, in case of editing or deletion.

    Thank you.

"But the enforcement team got it wrong."
    - It's not a matter of intent. You either did or did not violate the code of conduct. And there was enough for the Xbox Enforcement Team to make the appropriate decision

    - Consider it a learning experience

"I consider the remarks, tones and attitudes of both "xHAZMATRADIOx" and "ngocphi" to be disrespectful, insulting and quite simply appalling."

    - You consider my remarks offensive. I find that interesting based on everything you've stated.

    - You're welcome to hit that "Report" button and the info will go to the Ambassador Moderator of the forums for review. Please click that button

    - Just so you and I are on the same page, here are a few of the highlights from your other post that has since been locked

    - Quotes from Alaria below from the titled post "When the "Enforcement Team" get it wrong"

the customer is right, completely disconnected from other services, so arrogant that they believe that there is no one out there smarter than them. They act as judge, jury and executioner, and if you don't like it... tough.

When Batman and Robin from the Enforcement Team get it wrong, and I can assure them that got it wrong here,

Microsoft: show us the faces behind the Enforcement team. Give us names, email addresses and direct telephone numbers. When they become accountable to the customers, then we might see some justice.

I've never said anything like what you've stated to any other member here. I've never made demands of someone's personal info or made belittling or defaming remarks. You're disrespectful to the people here on the forums and towards Xbox as a whole.

Anyone that tries to help on the forums in some capacity is trying to give the person posting the question relevant info.

If anything, you could at least apologize to ngocphi and Smwutches and just say "Thanks for the info. I understand."
