when your licence transferring with a friend can what ever they are downloading continue when you sign back into your account on your console while the content is still downloading from the on your friends console?

If I remember right you can do all that on the Xbox website in your account. And just queue it all up .

To see your purchase history, go to Account Purchase History and sign in with your Windows Live ID (email and password).
Browse your purchase history. If you want to download something again, click Add to queue. This adds the item to your console’s download queue.
Turn on your console and connect to Xbox LIVE. The items will begin downloading.
Note Downloading previously purchased content to a different Xbox 360 console does not transfer the content's licence. If you want to use content without signing in to Xbox LIVE, you must transfer the content licence to the console. For information on how to transfer licences, see Can’t play content after console was repaired or replaced.

View Xbox Live Download History | Xbox 360 Source and if you want to do it from a PC instead thats also on the page. I find queuing from the PC easier

1. Sign in to Xbox Live using the gamertag that you used when you originally purchased the content.
2. Go to settings and select Account.

1. Go to Your Billing Options and select Licence Transfer.
2. Follow the instructions to transfer the content licences.

1. Select Download History.
2. Browse your download history. If you want to download something again, select the item, and then select Download Again.

License transfers are only meant to be used to transfer your licenses in the event that you get a new console. What you are doing can be considered marketplace theft and could get you and your friend banned.

 

It won't get anyone in trouble because it won't work you CANNOT transfer license from one account to another.

It will get them in trouble because what they are doing is not transferring the licenses from one account to the other but from one friend's console to another friend's console.

As stated above, this is considered marketplace theft and could result in both gamertags and/or consoles being banned if caught.

 

@Onyx62is it WOULD get them in trouble IF they could do it but they CANNOT do it so there is nothing happening to get in trouble for! The system will not allow it to transfer to another account PERIOD.

 

You are incorrect,it can be done & is marketplace theft which will result in a ban.

 

They're using the license transfer tool on each other's console to try to share content, not trying to transfer content between accounts. That is marketplace theft.

 

As I've stated before, I've spoken with several representatives about this where they attested to this being fine, as well as the fact that they list specific instruction on how to do this on the Xbox website.
