    so if that was the case we wouldn't need xbox live gold to play it ( if diablo 3 did come to the 360 ) because it would have an offline mode , i doubt they would let us play diablo 3 if it had to be online at all times on the xbox360 if we didn't have gold
    . so i would be hoping it would be available as offline play mode because i don't have gold live.

    This game is available on disc. On the Xbox Marketplace it it only available in the download version.

    You can try to visit a 3rd party retailer (by using their website or just enter the store) and see if they can provide you with a Diablo III on DVD.
