We NEED a "Play through both" feature on the Xbox One.

As we (people trying out YouTube and Twitch) all know, capturing game chat and party chat on next gen consoles is a ridiculous and/or annoying process. Kinects, numerous cords, and/or expensive microphones witch audio mixers are needed to capture voices
on the console. I know mamy have tried for this and the counter-argument is that there is legal trouble in recording voices. So why not, with a new patch, release a disclaimer that must be signed by each person downloading the patch stating that they recognize
that their speech may be recorded by others and that they accept full responsibility for what they say? Patch the console to allow audio to travel through HDMI and a headset with the disclaimer. Just a thought. Maybe Windows 10 will bring about this patch.
(HINT HINT IT IS A WAY TO MAKE THE CONSOLE MORE MARKETABLE TO YOUTUBERS AND STREAMERS!!!!!!!!)

While nyteflier is correct and the functionality to "share Gold" isn't on the Xbox 360 console. We have a very cool feature coming to Xbox One called "Home Gold".

Just to add. Both users don't NEED a Game Pass in order to use the Home Xbox feature.

 

I agree there should be a disclaimer but it should be making people aware that recording someone without their knowledge when they have an expectation of privacy is illegal. You can't make a disclaimer that allows you to commit a crime.

Look at the number of people that lose their jobs for social media post. If you post a YouTube video or a Twitch feed in which someone makes a comment that they believe is private and it cost them their job guess who's getting sued.

 

True. I just know there has to be some way around this? Maybe making a "Terms and Conditions of Use of Recordings" be signed when using this feature? Would that not legally bind the one recording to their actions and hold them accountable, not Microsoft?

Microsoft isn't accountable because what your asking for already exist (at least in the US). There are laws making it illegal so the person doing the recording is the one taking all the risk whether they are aware of the law or not.

If Microsoft gave you features to make the process easier for you and those features serve no other purpose then Microsoft opens the door for some liability. Just look online at all the people claiming they have been "bullied" "shamed" etc and are trying
to make a buck or garner sympathy. People today have very thin skin and the last thing you want to do record one of those people in a unflattering moment and show it to the world.
