Warranty Scratches

I was just reading my xbox one booklet that came with the console and something caught my eye a part saying in short Warrenty does not cover if console is dented or scratched. I hope I misread this because ive had my xbox one for just over a week and already
the glossy parts of it have LOADS of scratches I don't know from what though. Can anyone explain this plz?

Disc Unreadable

slim? it's a new console and should have warranty. it sounds like the console, if the disks are both clean and no scratches.

 

My console scratched a game (Assassins Creed 4 Black Flag) and can't read it anymore

My XBOX couldn't read the game since a few days and I looked at the disc.

There I saw a round scratch all over the CD and I'm sure that I did not scratch the disc somehow.

I searched the Internet for the issue and found out that the XBOX 360 laser could've done the scratch and that a repair in the limited warranty time (I purchased the device in August 2013) is cost-free, because it's a rellated issue.

My questions about this:

Is the issue covered by the limited warranty?

Who replaces my game for me? It's already not useable anymore.

 

Warranty only covers hardware repair that's the trouble with a nice shiny black console just blow the dust off and it will still leave scratch marks, I'm thinking of getting one of those kits which cover the console/two controllers/and Kinect.
