Voice communication that violates Xbox Terms of Service

A few days ago I was in a party with friends when an individual came into the party and started verbally abusing myself and other members in the party. He then went on to brag about how he had sent pictures of his private parts to a 13-year-old boy he had
had an argument with within the last few days. I have blocked this individual and he was reported for verbal abuse. Normally I would just leave things at that but the fact that this is a case of distributing child pornography I felt it only right to post this
account on the Xbox forums so proper action could be taken.

To add to what Internet Expert said the same applies to the use of Xbox Live, where by agreeing to the EULA when you sign up for the paid service, you are expressly told that by using the system and service you should have no expectation of privacy in anything
you do while on that service, be it gameplay, voice communication, messaging and no right to modify the console or any games contained within. In addition Microsoft determines what violates those terms not the user.

You haven't found any kind of loophole.

Games may be rated M, but anything done on Live, including private chats, are either unrated or rated E for everyone. So use of profanity, even in a private chat, does violate the code of conduct whether you're having an adult conversation or not.

When you create an Xbox account, you agree to the terms of use which does state that Microsoft can hear everything you do on Live.

You have done all you can if you reported him via the console. That is the only way to have enforcement look into things. Not to down grade what happened, but if this individual is over the age of 18, he did not distribute child pornography. That would involve
distributing pictures of under aged people. He would be more in violation of child endangerment. Anyway, good job in reporting this individual.
