unwarranted account suspensions by the enforcement team

I have to know. Why does the enforcement team fail at every turn when they have 1 thing they have to do their JOB and they cant even do that of all things. Why are they allowed to throw out account suspensions over the smallest little things?

Heres my story as to why i i even ask

Fallout 76 BETA today the 4th:

i was helping a couple players out just before the end of the session at 9pm when out of nowhere a guy on my friends list showed up with his brother in tow without any warning and started attacking us. Mind you we didnt want a fight as we were outclassed,
outgunned and outleveled. Me an 18 and the other 11 and 12 against a 22 and 25. Dont take a genius to see how that show ended.

well i messaged the one in private warning him they were being reported for greifing and harassment as they wouldnt leave us alone no matter what we did. When we were forced to defend ourselves we were killed instantly and multiple times at that. Bear in
mind i knew these guys attacking personally as they were the sons of an former coworker that was on my friends list. They didnt appreciate me reporting them for code of conduct violations so they reported me back in retaliation for communication. Now i did
tell them to [Mod Removed – Profanity]off and yes that is a violation but i had every right to do so given the situation at hand and i do take responsibility for that.

so as soon as i reported them not even a minute went by and i got a message saying i was comms banned for a week for communication.

now someone explain to me how 1 word of profanity equals a 1 week suspension while open griefing and harassment warrants no punishment at all. Enforcement have gone too far innocent players being "jailed" for things that are a simple slap on the wrist stuff.

ive been banned for no reason what do i do ?

First no one has the power to ban you except the enforcement team.

Second even if someone reports you does not mean you will get a suspension on your account unless you did something that was against the code of conduct which can be found here Microsoft’s Code of Conduct Explained for Xbox Live Customers

If you feel that your suspension is unwarranted you can sign into the account that has the suspension on it at enforcement.xbox.com and if the suspension is eligible you can file for a case review.

 

Completely Unwarranted Account Enforcement

Today you guys issued a completely unwarranted 24 hour suspension on my account and then proceed to not give me a chance to defend myself and dispute the enforcement. Microsoft Chat told me the only way to get ahold of the enforcement team was via the forums
which is absolutely ridiculous. I don't know how I can privately discuss this with the enforcement team but it is absurd that this has occurred and I intend to let you guys know it one way or another.

One simple rule... What ever you do, make sure you never break the code of conduct yourself...

The message you send or the words you've used is hard evidence.

As the other person was "just playing the game" they didn't do much wrong besides keep killing you guys.

The fact that you didn't like that and maybe it's not fair to keep killing the same person over and over, doesn't make them break the code of conduct...

So it's much harder to proof they did anything wrong then to proof you did anything against the code of conduct..

That's probably why it would take some time to take action against these persons, if any action will be taken at all.

Bethesda made it quit clear griefing would not be tolerated. They made that intention known that wasnt playing the game. They did that to make me quit as i dont get along with the one brother very well and he comes at me every chance he gets even when
hes told to back off. If a player runs it means no fighting but he chased us and for a good while. He refused to leave us alone. Thats called harassment. I had 2 other people in my group to back what im saying.

 

As you said. You know how you break the rules. It is really simple. You broke rules, you could get banned. Unfortunately.

 

its not black and white and microsoft is blatantly violating free speech and profanity is covered under that. the XET are the excuse to undermine the law. they focus on minor things and let major things go. youve all missed the point. both sides did something
wrong but one side got punished while the other was set free despite having done a worse crime. still wanna back them now? my violation was caused by theirs but yet its only MY violations thats the problem apparently. typical.

You admit in your post that you used a profanity in a communication to another player. That is a violation of the Xbox Live terms of service. XBL is a private network and as such you have no right to unrestricted free speech on it.

it doesnt matter if XBL is private as long as its on american soil they are bound by the law of this country. they are NOT above the law or the constitution. to say otherwise is hairline treasonous talk no matter how many lawyers they have no perso nof business
can say they make the rules. in other places that might fly but in america thats how you get kicked out the door.

sony understands this and as such they respect and value our laws. microsoft has taken these laws written in stone and wiped their
[Mod Removed – Profanity] with it because they believe money will give them special privilege to bypass what would effectively hurt them. simply put sony is for free speech microsoft isnt. weve seen countless example of shameless
censorship from them.

off is me expressiong my opion even if its not nice which is protected. the government or company cant censor or punish someone for that.

 

If you break the code of conduct high chance you get a ban

 

Frustrating most definitely. However the enforcement team wont see it that you and every right to do so. That old saying two wrongs dont make a right. Blocking them and reporting them would be appropriate. Then ignoring. When you engage with a troll
you feed them exactly what they desire. And by doing so put your own account at risk.

 

Retaliation is always a mistake, sorry.

 

Since you brought it up lets look at the first amendment to the US Constitution:

I will Highlight a few things here for you.

"Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the
Government for a redress of grievances"

So it says CONGRESS shall make no law It says nothing about a private company making rules on its own private servers that YOU agreed to follow when signing up for the service.

What many people do not understand is that the Bill of Rights was put in place to protect the citizens from the overreaching power of the GOVERNMENT.

Now as far as Bethesda policing people on their game as far as harassment that would be up to them.
