Unrightfully Banned for Communications...when I did no communicating?

I haven't been on my Xbox One in over a week, maybe 2 weeks at most. I don't know, I can't remember. But I thought, "hey, I wanna play a few games of Halo 5 since I haven't on in a long time" and so I did just that. I played maybe
1 game? Tried getting into others but didn't work out. So I just turned it off. That's about 20 minutes of gaming right there. 20 minutes later, I get a message from Xbox Live Enforcement saying I am now
SUSPENDED FOR COMMUNICATION BEHAVIOR... WHAT?? I don't play with my mic on, I don't talk to other players. I legitimately did not send any messages to recent players during my short game session. And I get a ban?

The ONLY thing that makes sense out of this is the fact that there were 2 Spanish guys in the game with me on my team, I heard them constantly talking and trying to team-kill each other. I ignore that stuff all the time.
HOWEVER.. although I don't speak Spanish, I did recognize them saying a word (a lot): "****" which means "****" in Spanish. So I'm going to assume that one of the other players that were on my team reported me thinking that I was the one talking and
saying vulgar words.

Enforcement needs better handling in reports in situations like these. This policy of: "guilty before proven innocent" is horrible and non-consumer friendly. I
want to enjoy playing what I want on my Xbox, without suddenly being randomly banned because some guy didn't have common sense and just wanted to report everyone who was in his game. It's not fair, it's not right, and I shouldn't have to deal with
this ban permanently stuck on my account record.

On top of that, I've tried sending in the Case Review thing and I got a "survey" to complete in order to be able to send a request to review. That thing is just full of trick questions and misleading phrases that will make you EASILY fail it, even if you're
a good gamer and abide by what rules you do know. I shouldn't have to waste a whole day because I misclicked a wrong answer, or read the question wrong because of how it was worded, or getting the question wrong for being so
INCREDIBLY VAGUE.

I love Xbox, I've been gaming on it since 2001 and been a loyal Live member for almost 10 years. I, nor others, should have to deal with all these false reports and instant ban's. It's just unfair. If it were anything else like with
hacking and cheating and I'm in the lobby with them, that's fine I can sorta get that (maybe?) but
communications ban when I had no microphone nor
did not send any messages towards anyone at the time? That just doesn't make any sense.

Hey mate, it's unfortunate, but even being in a modded lobby is enough to get your banned. Doesn't matter if you're the person modding or not. Also in my opinion, you should count yourself lucky it's just a suspension and not an account ban.

The enforcement team do not use the forums.

Any report filed is investigated first which takes time.You would of been suspended for something you did weeks ago or even longer.

The questionnaire is extremely easy & there to make sure you are familiar with the code of conduct.

Filing for a case review is the only way to appeal a suspension.If you have failed the questionnaire then you will have to wait 24 hours & take it again.

 

"Extremely easy" okay, then what's so wrong with having a purple avatar? Because apparently, having a purple avatar is not okay. That's incredibly vague and doesn't explain if it's referencing the actual Avatar characters or the profile picture. It makes
no sense. I don't see why I even need to fill out a questionnaire to ask for a case review; I should be allowed to defend myself freely and without headaches and tedious tasks, especially since I'm innocent. As far as I know, I've done nothing nor said nothing
wrong in the past few days or even weeks; as I mentioned, I haven't even been on my Xbox that much in the past 2 weeks. Even then I wasn't communicating with others besides friends.

I'm not even concerned about the enforcement team reading my forum post here; I'm just posting my unfair experience as a fellow Xbox gamer, letting others see that you can just get banned for doing nothing. This is an unfair, unfriendly system that hurts
the innocent gamers more than the abusive and guilty gamers that are causing problems in the first place.

 

The only way to have a purple avatar is by modding which is a violation of the ToU/CoC.

If you knew the ToU/CoC,which you should do,then you would know this.That's the whole point of the questionnaire.

There is no time limit on when you can be suspended for a offence.It could even be for something that happened months ago.

Any report is thoroughly investigated.You do not get suspended for no reason.

It's entirely up to you whether you want to do the simple questionnaire but if you don't then you can't file for a case review.
