  1. Unexpected Perma-Banned Account


    I've come here to today in order to make a case for my friend (Dragon0fDaWeast) in regards to his ban. He was recently banned for two weeks on Christmas, and then was permanently banned on December 26, 2016 after replying to the case review. Afterwards,
    he then attempted to appeal that permanent ban but was almost immediately shut down the same day. Since then, my friends and I have been calling Xbox support in order to see if there is anything else we can do to reverse this decision, but have come up empty
    with each and every attempt. This maybe our last ditch effort to restore to my friend what he has payed for and is rightfully his. It would be very much appreciated if anyone on the Xbox Live Enforcement staff sees this, reads through it thoroughly, and possibly
    give him another chance.

    It all started a few weeks ago while he and I were playing a multiplayer match of Rainbow Six: Siege together. My friend was wrongfully betrayed in the match by another player who then proceeded to message him first using profanity. In the message JEWMONGREL911
    (the betrayers gamertag) used profane language and insulted my friend who then felt it fair to reply back with offensive language as well. We assume this is what originally got him into hot water since my friend has not engaged in any disagreements with other
    players since. After this initial ban he received a message from Xbox Enforcement giving him a chance to appeal the suspension. Not having any knowledge or prior affiliation with this subsection of Microsoft; my friend then continued to write a satirical message
    that was not meant to be taken seriously. The expectations we had as a group were that the letter would either fall through the cracks and not be read, or that they would simply just uphold the ban that was already in place. What we didn’t expect was for him
    to attempt to log into his account, only to be greeted with a big red hammer and a permanent ban effective immediately. Lastly, this lead to a final appeal of the permanent ban, which my friend then took more seriously when filling out. However, almost instantly
    a representative from Xbox Enforcement cited that he “harassed, abused and threatened” them in the previous message and was going to uphold the ban indefinitely. This is where we are at today.

    Reasons why his ban should be revoked



    - First time offense (This was his first time being banned ever in the history of him owning this account since he made it all the way back in 2009.)

    - Reputation is green (Based on the system that Microsoft has put in play, this represents the reputation he has built up with the community over the years and it is clearly a positive one.)

    - Unbalanced distribution of punishment (My friend essentially lost thousands of dollars he has put toward this company, as well as tens-of-thousands of hours he has invested on this account since he was fourteen years old. All this for
    one bad message is a bit overkill.)

    Reasons why Xbox Enforcement is flawed

    - Uncontactable (Other than the appeal system, there is absolutely no way to contact them and consult with them about bans.)

    - Answers to no-one (Based on the nine calls we made to Xbox support, we have come to the conclusion that no one on the support team or anyone for that matter knows what goes on in Xbox Enforcement. This is all contrived from statements
    given to us by your representatives and it all seems a bit shady. Not only that, but it opens up the door for a serious issue of abuse of power.)

    - Copy/Paste responses (Simply put, it feels as if a bot has the final say so on your accounts very existence and gives blanket statements on your offenses.)

    - Appeal survey treats you like a child (The survey you are required to fill out before you may give your statement treats you like an adolescent, belittles your very intelligence, and they take this seriously when it comes to if you deserve
    a chance to appeal or not.)

    I feel as though I have given an honest and reasonable response as to why I believe my friend deserves a second chance and his account should be restored to him in full. Throughout this ordeal we believe our friend has been treated unjustly and would like
    to just move on from this and be able to play with each other in our down time once again. Also, I forgot to mention before that he does not even have access to his home since he left it logged into another friends xbox and that is the reason why he can't
    access any of his payed content whatsoever. I would like to thank anyone who spent the time to read through this post in full and for the cooperation I may receive from the Xbox Enforcement team.

    Am I being paranoid?

    If you aren't doing anything wrong you'll be fine, and they'll basically only perma ban your account if you modify it.

    The enforcement team do not use the forums.Filing for a case review is the only way to contact them,if your friend has already done that & the decision was upheld then that's it,they will not get the ban overturned or their account back.

    Just because it's a first offence doesn't mean someone cant be banned,the length of a ban/suspension depends on the severity of the offence,not how many times someone has been suspended before.

    Rep has nothing whatsoever to do with whether someone can be banned or not.

    As per the ToU/CoC your friend agreed to,you forfeit all digital content,remaining gold etc. if your account is banned.

    Support are nothing whatsoever to do with xbox live enforcement so can't help you.

    The questionnaire is there to prove you are familiar with the ToU/CoC

  5. Obviously the only way to contact with enforcement team IS with filing for a case review. That's one of the points up there with what's wrong with this. This is THE ONLY WAY. Anyone who calls support will get the same answer from reps saying how powerless
    they are to any decision upheld by enforcement team and they go on unchecked. (https://xbox.uservoice.com/forums/251649-accounts-subscriptions/suggestions/6164387-get-a-account-back-enforcement-team-manner)

    As you can see many feel this way and would like to see some change to this unfair system. Also The code of conduct states that permanent bans are for "egregious violations", if you try to avoid suspension with alternate accounts and/or devices, or if you repeatedly
    commit violations. I'm going to say it is not the latters for this is a first violation and no alternate accounts is brought into question. (Microsoft’s Code of Conduct Explained for Xbox Live Customers) here is
    the code of conduct for you to read.

    So therefor the only reasonably option for this permaban is "egregrious violation" this makes it more of an opinionated subject of whether his repeal was egregious enough for enforcement team to permanently ban him. Of course there is no third party to look
    into the case to decide that as the only ones able to are enforcement themselves only way is a small text box repeal that you can only use once.

    You can continue to copy and paste the same reply all support has been giving, but when so many people are having problems with this flawed system, and they want change or a better solution to handle these situations, how are they supposed to with these results?
    What are they to do to actually get some useful support? There is no power checking the enforcement team and they seem to reign supreme without supervision or a second consultation.

    him less culpable, but it does sway towards the narrative that he previously had no offenses and that should matter. Most systems give you strikes before completely tossing you to the side, not one and done like this flawed system. Lastly, re-posting information
    that I already brought up in the initial argument, such as support not being able to help, does not make the issue any less egregious and further cements the issue.
