Only an actual person from the Xbox Live Enforcement Team can impose or remove a suspension or ban on the account. - "Despite what some may claim, Xbox Live Policy

Code of conduct violations encompass a number of situations, including, but not limited to:

• Engaging in communications that claim or imply that you are Xbox staff
  
• Having a Gamertag or profile content that contains hate speech or profanity
  
• Using in game exploits to gain an unfair advantage over other players
  
• Hacking, Modding or Cheating

Gamer pics get banned fairly regularly. Usually it's because someone has an historical figure in their pic that has some kind of stigma attached. It may not offend the person using it and may not be intended to offend anyone else. Someone complains though
and there you go. Best thing is to change your pic and move on. I'm guessing you got a 24hr ban but if it's longer you
could appeal it.

Microsoft are like disney, supeeerrrr sensitive.

basically anything to do with anything can get you banned, having any flag as a pic with get you branded as bad one way or another, they should scrap pics and just have nothing as everything will offend somebody these days. lets make life like Equilibrium.

I find it offensive that a lot of games have the new rainbow flag in as they are representing a group over all others.

Because 99% of xbox live users can be trusted to follow the rules.

This is something the community wanted so Microsoft should be applauded for adding this feature.Doesn't matter if someone is offended by a certain pic or not,if that pic is within the rules then it's fine.

It's no different from gamertags,

You'll only get a 24 hour suspension unless you continue to use gamerpics that violate the rules.

If someone doesn't learn their lesson & continues to upload offensive gamerpics then they deserve a ban.

No, you will not get banned for using another countries gamer pics, as its not really infringing upon any patent issues or region locked content. It might be exclusive to a region, but its a picture so just like taking a picture using the Vision camera
of Mario and having that as your gamer pic, will not get you banned on live. Now if its a naked person, then yes, you will violate the Code of Conduct and will be banned.

If you continually switch regions to access content from other countries, that might end up raising a few red flags
