no, as the original account holder would have to make the console the home console for that to work, technically the xbox should not have been sold with games on it as they are non transferrable.

Even if you fixed the older console the games could not be transferred. They are only linked to both the gamertag that orignally bought them and the console that is set as Home. If the person that originally bought them decided to get a new console and set it as Home you'd immediately lose access to them

Unfortunately, the games that were on the console you had belonged to a different account that was set as Home on the console before it was sold. If you haven't previously purchased the games you would now need to do so. But don't worry as your save will still be ready for you and would just need a brief moment to sync to your account when you redownload the game
