I'm a Party Planner by trade and a client has booked me for her sons 16th birthday.

He wants to be able to have multiple stations throughout the event to play various xbox games with his friends during the party.

As I am being paid to arrange and supply everything (including the use of xbox and games), what kind of trademark/copyright/licensing laws do I need to declare to Microsoft? Can I even use the xbox and games when I'm making money out of it?

    :)

    Hi G-Party-Planner,

Thank you for writing to Xbox Community Forums.

We understand that you are trying to inquire regarding trademark/copyright/licensing laws on Xbox gaming. As per your post description you stated that you are a party planer and was asked to host a game party on various Xbox games involving money while gaming.

Gamertag/Live Account is taken, however I own the name and it is potentially being misused

Even if you register *NAME* as a Trademark, that does not create a presumption that you have rights to the name in Xbox Live, as the no-commerce clause in section 1.10 of the Terms of Use presempts that as per

If you _really_ want it, then send a nice message to them and offer them the Microsoft Points required to change it. Flies, vinegar, honey.

    Sales question.

The first-sale doctrine plays an important role in copyright and trademark law by limiting certain rights of a copyright or trademark owner. The doctrine enables the distribution chain of copyrighted products, library lending, gifting, video rentals and
secondary markets for copyrighted works (for example, enabling individuals to sell their legally purchased books or CDs to others). In trademark law, this same doctrine enables reselling of trademarked products after the trademark holder put the products on
the market. The doctrine is also referred to as the "right of first sale," "first sale rule," or "exhaustion rule."
