The ability to appeal

About a year ago, I have been forced a gamertag name change due to being reported and as a result I had to pay 9,99 euro in order to have a name which uniquely identified me.

Before actually making the purchase, I have had contact with Xbox support to verify and make sure this would not happen again. This morning, I logged in to find out I have been renamed to something random again.

Puzzled, I have contacted Xbox support per chat which has sent me here.

Now, as it was not a free change but an actual purchase, the Dutch law grants me certain consumer rights to this service. Because you deliver your services in The Netherlands, in our local currency as well, Dutch law applies here. (Check with your legal
department for more information). One of these rights is granting me the ability to appeal as stated in the "Telecommunicatiewet" (article 7.1F, article 12.1 through 12.9) and European Guidelines 2002/22/EG (Article 47) before taking it to any court. A simple
forum post is not recognised as an official procedure, and I will involve the "Autoriteit Consument en Markt" on the grounds of charging me another 9,99 euro based on what I see as an error in judgement of the Enforcement team.

Why I am doing this? Various reasons:

- Out of principle. This seems to be a way of your company to make extra money outside of the delivered service.

- I feel wronged. I report people which exploit, cheat, harrass and for unsporting behaviour. This makes them report me back sometimes when confronted. I try to make the gaming world a better place and this is my reward. If I did NOT report, I'm confident this
wouldn't have happened. Please match my reports to the person which reported me.

- I have checked with Xbox support for this name and it was approved. This forced namechage contradicts your own words.

- The moment an anagram becomes a curseword is the moment we can toss out the dictionary and moderate everything. I.e. Anyone with "Snipe" in the gamertag should be forcechanged as well as rearranged it becomes a medical term for a male reproduction organ.

I wish to resolve this problem with you first. This means; allow me to change my name free of charge before the need to escalate this. If you deem this is not in order, I will require a proper and private way to appeal the enforcement decision. In case that
will not lead to a satisfactory outcome for all parties, I feel I have no choice but to take this to the Dutch court and escalate as far as I can, possibly to the European court. Mind you, a verdict there would be effective immediatly on all your services,
comparable to a "class action suit" in the US. So please take this seriously.

On a more personal note: Don't mistake me for a rioting teenager. I used to work for Microsoft; supporting LiveID, Messenger, Profiles and *** Die E-Mail-Adresse wurde aus Datenschutzgründen entfernt. *** so I know how it works internally. I fell ill a few years ago and even though my body is failing, I do
have a working brain and a lot of time on my hands. Amongst the little things I have left is my internet identity, which you have blatantly took from me. This is why it's important to me, and why I'm willing to fight for it if I have to.

Microsoft Considering Making Digital Games Cheaper

Digital doesn't really appeal to me at this point. I like having physical merchandise and having the ability to resell it at any point. I will consider going digital with 'keeper' games or crazy xbox live store deals.

 

gears of war 4 ban

Game developers have the ability to ban players from specific games seperate from the greater Xbox LIVE. Microsoft is powerless here. If you wish to appeal, you'll need to visit gearsofwar.com. I don't play Gears of War so I would not know if you can appeal

Phone and chat support don't handle enforcement issues so even if they approve of a gamertag, it's entirely up to the enforcement team. The enforcement team do not use the forums. You would need to go to
http://enforcement.xbox.com to submit a case review if possible.

Also, you do agree to the forced name change policy by agreeing to the code of conduct.
