Someone else has my account

So, here's the thing:

I created my xbox account years ago using a mail that i was using as a teen. At some point that hotmail got a virus or something and seeing as how i wasn't using it, the mail was deleted/changed/i lost acsess to it. When i tried to get it back it seemed
the mail had been taken by someone else, the security question and the secondary mail was all different from mine. Back then I didn't really care because i wasn't using the mail anyways and up until now i have always been playing xbox offline.

I had, mistakenly, believed that the password etc for my xbox account was different from that of my hotmail but when i tried to connect to live the other day, the password was changed there too. I tried using the tool to recover your account or whataver,
but seeing as how someone else is using my old mail it's literally impossible for me to answer the questions. I'm not even interested in getting my mail back, but my gamertag and xbox profile is NOT something i want someone else having acsess to and its also
not something i want to give up. And even if i made a new one, the new owner of the mail could theoritcally log onto my xbox account, right?

I have no clue what to do. I really just want my gamer tag removed from an account that is no longer even mine. I'm also really annoyed at the fact that my mail was just deleted without my say so leaving me with accounts that i have used money on that is
now someone elses.

What can i do to get my gamertag free from this account?

Hello there!

First of all, I suggest you
Change Your Microsoft Account Password. However, you should
Contact Phone Support for them to make an ''Unauthorized Access'' investigation on your account. That contact link is for the U.S, if you are not from that country, scroll down on the page and click on the small lettered 'United States' of which then a
list of countries will appear, click the country of your residence. This will then, for when you request a call, connect you with the correct people in your (or closest to) your nation.

Following the steps in this guide, the conclusion was to call Xbox Support.

Hopefully with some proof of account ownership, they can help you further. Due to this being account security related, there is very little else that can be done for you here on the forums. The phone support team do have direct account access so they can
look deeper than most can here.

As instructed on the final step of the above guide, be sure to have another email address set up so that they can correspond with you further there if needed. You can set up a call on the above link by clicking "contact us" at the foot of the page.

Well if you have used your Gamertag on another Xbox, simply login with your gamertag back home with your own Xbox. This should restrict him from logging in with your gamertag, until you go back to his console and play again, and so this step will have to
be repeated again.

Another way to make sure that he/she won't be using your gamertag, is to delete your gamertag's profile data on his/her harddrive.

Hello,

That's the issue he got on my xbox account an removed all my chats with everyone and blocked them. On top of that he messaged himself from my account, thus getting me com banned. He harrassed me on different platforms too, and way more servere. After I blocked him on all other platforms he went on my account and did all the stuff that I have mentioned before. So my request is if something can be done about him. I can provide evidence of him being on my account and harrassing me. All I'm wondering is if something can be done to his account because I want to prevent other people from having to deal with this kind of behavior.
