Selling digital copies

Hi, I have a question. On eBay people are selling digital games which you can buy. Be given an account to sign into and download the game. Then you can play on your own Gamer Tag. I assume this is illegal. If it is, how can eBay allow them to be sold?.
Some of these Sellers have hundreds of positive feedback.

Well that well deff get you into trouble but on the topic wish there would be a way to sell your digital games you already own but you know you aint gonna play no more and just sits there doing nothing even if it was a fraction of the price or.something
how many of us pre orders new game then it turns out complete **** with a disc you will at least get half back roughly but digital your just screwed

don't if it's illegal, but you will be banned for that, so stay away!

I'm not sure about illegal, but it does violate Microsoft's terms. All you can do is report them to ebay though.

No, you can't exchange hard copy to digital. Best way to sell the game to someone and then bought digital copy by web on xbox.com.
