It has come to my attention that my gamer tag/ name has become politically incorrect. It has gone the way of 'Apu' (Simpsons). The name creates in question was conceived over a decade ago by a 12 years old Australian boy.

My direct question on the topic is;

Should I have the choice to reselect my own gamertag/name and should I receive a financial penalty to change from a non generated one provides to me.

A name change is $14 Au.

If you were given a forced gamertag change, you would need to go to http://enforcement.xbox.com to see about submitting a case review. If the enforcement team overturns their decision,
you will be given a free change. Otherwise, you would have to pay if you want to change your name. They used to allow free changes with forced gamertag changes, but that was abused so it was taken away.

You're assuming that people would blindly buy another console after being banned despite being "innocent".

The thinking behind trusting you again after buying a new console is that the massive financial penalty you incurred will make you think twice before commiting another offence. Hardened modders will keep doing it unless you physically put a gun to their head
but they miss out on XBL. Average users will be deterred however.

The heaviest weapon you have on you determines your movement speed.

If you've got an SMG, you'll move quite quickly up until you pick up, say, an LMG and holster that. Having a pistol incurs no movement penalty, just like a shotgun or an SMG.
