Regarding Your Updated Terms of Service & Your Failure to Enforce Them Properly

Your New Terms of Service state this policy:

... and your users adhere to them like cheap glue on a rainy day.

I called to report it and was told by an "account manager" that he was fine with rules being broken. I was appalled. Someone is impersonating me by real name on your network, and is now making "imp" accounts to defame me in addition.

A player hijacked my original gamertag, started using my actual real name and a Gamertag I held for eight years, within days of my changing it. He refuses to give it back and is now bullying me via other channels, as others have used posts from this forum
to do in the past to harm my business name, despite my repeated requests for deletion of sensitive information from your public forum.

I loathe that this crap company won't even give us a chat rep in the Congo or a phone number without a ninety minute wait, but this is precisely why I'll be going with Apple when they release their system. I want to be assured that no one will be damaging or
impersonating my name, per *YOUR own policy*, when I leave this network.

You will stop this child from using my real name on your network, and make the offensively-created imp accounts go away at once. What's happening now on your network is legally actionable, and you are letting it happen. You will resolve it.

I suggest you to file a complaint through your console regarding the persons you suspect as violators of xbox live service rules. The enforce team will investigate your complaint; in the meantime you shouldn't mention other gamertags in the forums!

Support does not handle enforcement issues. If you haven't already, you would need to file a complaint on him via the console. That is the only way to report a user to the enforcement team.

 

This reply is insufficient. Action is not being taken. He has been reported, and the name still exists despite the report. Your policies are not being enforced. I was told to reach out to this channel directly for action.

Clearly, this posts stands as a representation that policies on your network can be circumvented. I can also call your phone support channels, notify them, and be told that no one will care.

One you have no say on who gets suspended or when the suspension occurs

Nor will anyone ever tell you the results of the investigation

Due to privacy laws you only can file reports and that's it

Anything else like calling out players is not allowed

Impersonating you doesn't do much as it would be far impossible to find you in the 50million xbox live users

Report and leave it to the pet to deal with it

Unless you have copyright on your name you don't own a name

 

Actually, laws protect my own name and rights in many more ways than this.

If I can prove that someone is impersonating me & threatening to damage my name via your network (which I can in this case), and you are allowing this kind of damage to be done on your network (which you are), you are technically aiding and abetting the perpetrator
of the harassment. That has nothing to do with privacy law.

By this token, users can now impersonate whoever they want on your network if they have a real name, and no one will be able to say anything to them. I want to thank you for giving me this insight as to how your updated Terms of Service work. You've educated
me today.

According to the law and legally so you don't own your name or the network access

Ask any judge or lawyer and be ready to be laughed out

You are one in 7 billion people there is always same name

One in 20 people would have the same name so how is your precident?

Harassment is a separate issue and only when people communicate with you

they are talking about impersonation of famous people and copyrighted names and pet or moderator's not common people again you are making an issue of nothing

If you want to try and copyright a personal name go ahead fyi you can't copyright a personal name you have to have a trademark or reason for it and most lively be denied

Personal names are just that names

Copyrighted names or famous people have to provide ms a dmca notice to have a trade mark name removed

Again you arent getting or understanding the terms of use as they manager mentioned

 

This issue shouldn't be taken up in the forums if you have an complain about another player for harassment
Block the user and Report bad mouthing the company doesn't do a thing to help your case. Also we can not take action on this player for we aren't the enforcement team, posting this forum here is nothing but a rant at this
point if you want to get your word across take it up with the enforcement team.
