refund or theft

I don't know if there is a particular hard limit, but the refunds themselves are subject to how much you use them. Therefore you have to use your best judgement and don't overdo it on the refunds, because you could be barred from receiving them. Err on the
side of not asking for too many.

They have recently started allowing digital refunds. However is a user frequently requests a refund it will likely be investigated for marketplace theft.

Disputing Xbox purchases with your bank is considered marketplace theft. Marketplace theft is against Microsoft's ToS and will usually result in an account suspension.

Virtual currency usually can't be refunded, especially if it was bought while the game was open since the currency is immediately delivered. Refund requests are a final decision, if it's gets denied then you can't get a refund under any circumstance. Attempts to circumvent the refund policy via chargebacks or disputes will put the Microsoft account at risk.

They only consider it theft Electro (not thieft) if someone obtains a refund for a game then purchases the same game again plays some more of the game then goes for the refund again and then repeats the process. So in for genuine cases they don't consider
it theft and stop trying to make them out as the corporate bad guys as usual.

So you mean you got refunded but still have access to the games?

If not, then you can't be banned for theft if they took the games away from your account with the refunds.
