Hello Manny, sorry to hear you're having trouble with your console.

Usually if a repair has been refused then it suggests a self repair has been attempted on it. This would void any warranty and repair would not be given in those circumstances. However, to get more information on the issue itself I would recommend starting a chat at https://support.xbox.com/contact-us. When you get to a fellow Xbox gamer ask to be escalated to a Microsoft Advocate. They'll be the ones who can let you know the exact issue here.

Settings > Apps > Installed Apps > Search for the game > Advanced Options > Repair.

If it's still not showing up you may need to reach out to Forza Support.

Also, if you would like to proceed with the refund, I apologize but just a friendly reminder that for refund concerns there is a dedicated team that handles them which is the refund team. There is no direct contact with them, only by submitting a refund request and by replying to their email (refund request confirmation and refund decision). I'm slightly confused; the conditions for repair, replacement, or refund all fall under section 6a. So if the conditions have been satisfied to request a repair or replacement, wouldn't that mean those same conditions have been satisfied to request a refund?

As for the determination of if the malfunction was due to misuse, who makes that determination? If the console is sent in for repair under warranty, and the repair center preforms the service, wouldn't that mean the malfunction was determined to be within normal use, and therefore qualify for a refund?

I haven't experienced the console shutting down with any other games, but I don't have any other X|S version games, and if the other threads on here are to be believed, the issue seems to be isolated to X|S version games.

I think the exchange is a refurbished console. You get that console while they fix yours. But I'm not 100% sure how that works.
