If he has the console set as his Home console, you can access the games on your account. If he were to get another console and change that setting, you will lose access to the games. Digital content and accounts cannot change ownership. It is a violation

You might have access to the person's games for now but it's not guaranteed how long you'll have access (unless you coordinate with that person). When you setup your own account/gamertag, you don't own
