Question Regarding Digital Games and Two Xboxes

I presently have an original Xbox One that my young son and I have been playing for quite a while. We've been playing under the same gamertag up until this point and have downloaded several games.

I'm planning on purchasing the Xbox One X and "giving" him the old Xbox along with creating him a new gamertag.

My question(s) are this - there are some games that I'd like to keep under my gamertag (on the new Xbox One X), and there are some I'd like him to have on his new Gamertag (on the old Xbox One). Obviously games we'd like to play at the same time would have
to have two copies purchased, but what's the best way to go about giving his new account the downloaded games I'd like him to have (if it's even possible)? Am I totally out in left field? Thanks!

You would just need to set the old console as your Home console and he can access the games on his account. As long as you're signed into your account on the new console, you'll be able to access everything. My Home Xbox Setting on Xbox One | Share Your Xbox One

if it's a digital game, you'll find it in the ready to install section of my games and apps.

Thanks Denis … I thought as much... so what if the original purchase was a digital download (think I bought a Lego one in the sales!) I've always liked to have the physical disc but I might be regretting this now !!

The gold sub will work, but you'll need to buy the digital version of your disc games.
