    Question about Microsoft's Game Content Usage Rules


    If for example, one made a 3d model/derivative work based on Halo (for example 3d model of spartan armor for a video game mod), does the GCUR entitle everyone the ability to use that model/derivative work without the derivative artists permission, or does the derivative artist have permission to limit the use of their derivative work to those whom they give permission to use. In other words, does the GCUR give permission for anyone to rip the derivative works of an artist.

    In example, I make a derivative work of spartan armor. Can anyone just take that model and use it for their own mod without my permission granted by the GCUR.

    Distribution of your Item in any form constitutes a grant by you of a royalty-free, non-exclusive, irrevocable, transferable, sub-licensable, worldwide, license to Microsoft and any of Microsoft's partners or users to use, modify and distribute that Item (and derivatives of that Item), and use your name if we choose to, for any purpose and without obligation to pay you anything, obtain your approval, or give you credit. And this license to Microsoft survives any termination or expiration of these Rules.     This is a very grey area, and is entirely dependant of the company that makes the games themselves. If the content you are making is any of the following; commentary, search engines, criticism, parody, news
    reporting, research, teaching, library archiving and scholarship, it could protected under the "Fair Use" laws of copyright laws. It may be a better idea to take a look at the content usage rules of Twitch and YouTube,
    as there is where you'll be penalized for breaching any rules, not on Xbox Live.
