Problems with warranty,says console banned

The only way to check if a console is banned before you buy it is to try and access Xbox Live through it. If it is banned a message will pop up saying so, if it is not banned it will access Xbox Live perfectly fine. If a console is banned it cannot be un-banned
by Microsoft and will most likely have been opened previously and have no warranty.

Performing self repairs on your console will not risk a console ban. Flashing/Modding will. My warranty has expired so there is really no harm in trying to fix the issue myself or "voiding" my warranty. I would rather do that than send the console in for
a fee of 99$ with no guarantee that the problem will be solved.

So is it permantely banned if it just say the console is banned from xbox live

The warranty on a second-hand Xbox console is void, and the purchaser assumes the risk for any previous modifications or unauthorized activity. Even if the console’s ownership has changed, the console may still be subject to a ban. If you purchase
a console that has been previously banned you will not be able to connect to Xbox Live, and the ban will not be lifted as a result of the change in ownership. We recommend customers who believe they have not committed actions on the service to warrant a ban
to contact previous owners or users of the console.

I'm not sure about the error problems, but at this point it would probably be best to buy a new console because you've voided the warranty and by swapping disc drives you've also violated the terms of service so the console can be banned.
