    Your first action when you suspect server issues is to go to
    https://support.xbox.com/xbox-live-status     to check the Xbox Live service status.

    If necessary, check back after a few minutes, if the issue just happened, and they need some time to update the status.

    That page will give you most up-to-date information about what the servers on Xbox Live are doing.

    If you are unable to play multiplayer games from a certain company (for example FIFA, Madden, Need For Speed with EA's servers is giving you trouble, but Call of Duty whose servers are run by Activision work), you might have to check the publisher's support
    websites (in this example, where FIFA and Need for Speed aren't working you would contact EA support. If only Call of Duty games don't work you need to contact Activision).

    Why do i get probation for lagging out of the game

    Have never had any problems playing games online before Black ops2. Lagging out of the servers all the time. My connection is 60/60 (fiber), and nat is open. This is a problem with the servers or the game, not our connection so go f... yourself.

    The status page does not report any problems with the xbox live, it may be a temporary problem on the game servers or a problem with your internet connection.

    As you say you are connected to Xbox Live which rules out any problems with your Internet connection. May just be a problem with the MW3 servers. Either wait it out or play another game until it's resolved.
