Permanent Suspension for harmless behavior

I received a permanent suspension for Harassment and Abuse on my other account (Gamertag: "Fedz") for
failure to correct my past behavior. In
2014, I used profanity and vulgar language in my messages. Ever since my
first suspension I completely cut out the use of vulgar language and profanity
entirely.

How is that a failure to correct my past behavior? I seriously don't know what I did or said that was considered Harassment and Abuse in my recent messages.

Here are the types of messages I would send to people who annoyed me/trolled me/instigated a response by me:

1. "Trash"

2. "You're not good"

3. "Soundwhore"

4. "Enjoy the ban"

5. "Idiot"

Here is what could lead to me saying those messages.

1 and 2: Referring to the way they played the game. That game is Call of Duty. Highly competitive game, this should be considered as "smack-talk".

3: Referring to people with expensive headsets. This allows them to listen to every sound and detail within the game. Such as footsteps. This is an extremely common term used within the Call of Duty community. The word "soundwhore" is in no
affiliation with the actual definition of the word "****".

4: Assumption that they were cheating, exploiting, or using products such as a modded controller to gain an unfair advantage to a game. This also included people who "boosted" their rank in Call of Duty. Boosting is against the rules and the
game developers said that boosting will lead to account resets and bans. I would report them in-game for it and then send them a message afterwards saying "enjoy the ban". I was not implying that I would personally ban them.

5: I would never use this word lightly. I only used this word when someone messaged me first provoking me. First, I would receive a "hate mail" message. They would use vulgar language and profanity to insult me. I would reply back using this
word. The word "idiot" is the absolute worst of my language.

Permanent suspension for harmless behavior?

I received a permanent suspension for failure to correct my past behavior. I know everybody thinks they're innocent in these permanent suspensions. I know you probably think I'm one of them, but I truly did change my behavior. Let me give you an overview.

When I received my first temporary suspension for two weeks, I thought it was for my profanity and vulgar language. Here are examples of the language I used in my past messages which lead to my first suspension.

1. F**k you

2. B**ch

3. C*nt

4. Re**rd

5. F**got

I received a "Harassment and Abuse" violation. My suspension for that behavior was definitely warranted. After this suspension I completely cut out this type of vulgar language and avoided using profanity entirely. I haven't sent a message to someone using
that type of language ever since my first suspension (which was in 2014).

However, Xbox Live is a competitive place and sometimes you run into people who annoy you. Since I cut out the use of vulgar language and profanity I decided to find an alternative way to convey my feelings in a harmless and constructive way so that it won't
be a "Harassment and Abuse" violation. Here are examples of my recent messages that I believed were great and harmless alternatives to my past behavior and why I said it.

1. Trash

Reason: If they played the game weird or poorly. I would imply that their play style is "trash".

2. You're not good

Reason: Similar to the first reason except I send this to people who performed better than me.

3. Enjoy the ban

Reason: Assumption that they were cheating, exploiting, or using products such as a modded controller to gain an unfair advantage to a game. I would report them in-game for it and then send them a message afterwards saying "enjoy the ban". I was not implying
that I would personally ban them.

4. Idiot

Reason: When I am on the receiving end of "hate mail". I would RARELY reply to their message using this word.

Note: This is as bad as my recent language gets. I usually reply to them saying this after they send me a message containing extremely vulgar language and profanity.

I know the enforcement team didn't read my messages, they just saw that I had the same violation in the past and slapped me with the permanent suspension. If they compared my past messages to my recent messages they would see that my behavior has changed
drastically. I was trying to figure out what exactly lead to those suspensions since they don't flat out tell you what you said. I changed my behavior but still received a ban. If they flat out told me what I did or quoted a message by me (that was deemed
a violation of the Code of Conduct) as an example, I would completely avoid that behavior.

So, in conclusion, I changed my behavior. I completely changed the type of messages I send to people. But it didn't stop me from getting permanently suspended for the same violation; Harassment and Abuse. Could my recent messages pass for Harassment and
Abuse? Possibly. But that's pushing the boundaries of what could be considered harassment and abuse. It was harmless behavior. I'v seen Disney Channel movies use worse language and behavior.

Was it the same violation? Yes.

Was it the same behavior? No.

If my recent messages are considered Harassment and Abuse then tell me that. I will completely and entirely stop sending messages to people if that's the case. Just look over the account and compare the past behavior with the recent behavior. It is COMPLETELY
different. Saying I failed to correct my behavior and issuing a permanent suspension is a misuse of policy enforcement. I should not have received a permanent suspension.

In your own words... "Enjoy the ban!". Maybe it's just me but sending anyone unwanted messages is pretty much harassment in my eyes. Vulgar language has nothing to do with it. Again, that's MY opinion. I can only assume that enough people reported
your messages to get this reaction from those to whom I shall not name. When someone sends you an unwanted message it's much easier to just click the "ignore" button on them. Again, that's just MY opinion.

It never ceases to amaze me how bad the COD communities seem to be. As someone who's been visiting these forums for a while, I've seen so many "I don't deserve this ban!" threads from players of those games. Good luck trying to get your ban reversed.
I imagine it's very rare to get such things overturned.

I should also add, if you're not already aware, that literally no one from Microsoft visit these forums. (or so legend has it)

If I sound heartless, I'm really not. I just know how to ignore unwanted messages. As lovable as I am, I've gotten a few on my Xbox journey. Go figure.

I agree with Goth Vampirella that sending anyone unwanted messages can be considered harassment.

Something to keep in mind, written communication can be one of the worse forms of communication as tone and inflection (which aid in the message meaning) is interpreted solely by the recipient. Often times based on recipient's mood/feelings at the time of
reading, and not always as the sender intended it.

It's another reason to ignore, avoid, block and/or report messages/users (which ever option the user fells is most fitting for the situation) based on the
Code of Conduct or
Terms of Use.

 

Please follow the steps provided by sara to look over any misread terms and rules provided by the Enforcement Team.

Alright. So by that definition, if I did not want to receive this message by you (aka unwanted message) then you are harassing me.

Does that mean sending a random person a message saying "hi!" could be considered harassment? What kind of logic is that.

 

You seem to be under the impression that you can only be harassing someone if you are using vulgar language. Also you seem woefully oblivious to the fact that the examples of your current 'good' behaviour in messages can also be considered harassment. Face
it you weren't sending them to be nice, you were sending those messages to illicit a bad reaction from the other player.

Perhaps you should follow the advice of "if you don't have anything nice to say, then don't say it at all." That may stop you getting another ban in the future.
