    Same problem here, so my xbox is useless right now, Microsoft fix this ASAP, not a good way to keep users happy.

    LOL...... small claims court? Really? Isn't McDonalds looking for someone to work the night shift and contribute to society vs plugging up the court system to fight a free game mistake? People never cease to amaze me ; in a sickening way.....

  5. Well thats nice and all about being sickens and stuff, but when someone sells you something they can't just "take it back" regardless of the price. I went through with the transaction so I should own it.

    not sure how they are affected in the uk, as the stores on the highstreet use to have to honour wrong prices advertised in store, but the regulators in this country changed the rules and the stores did not have to honour them, once the store was notifies
    of the mistake they had 24hrs to change it to the correct price, i wonder if this applies to online stores also.

    At the end of the day you downloaded something you knew shouldn't be free so I think you're lucky to lose the game & get some xbox live credit

    Law in pretty much the entire developed world protects Online Purchases and Sales from pricing errors. Law has accurately described the difference between a "brick and mortar building" and in pricing errors in which most are obligated to uphold an error made
    on their behalf and an Online Service that allows purchase of either Physical Goods or Digital Services.

    I'm not in anyway trying to make a statement of a legal claim or an argument from authority fallacy but anyone is free to simply

    Google results
    to get a clear understanding of how both Consumers and Manufactures or Retailers are protected in regards.

    In short, Online mistake in price can be revoked.

    then MS would just file an appeal, and string any judgment, no matter how small out for years. For "Too big to jail" corporations has no morals, and will even spend millions bribing law makers in order to make sure they have an out in any situation.

    But what about the consumer? What do they have? Well, it's safe to say they have MS's moral support. Courts? - Not anymore as Courts are far too expensive for the average person and just as crooked as the Salem mobs hanging people suspected of witchcraft.

    But, if I were at work. Whether for myself or no, I would actually work so that mistakes like that couldn't happen.

    Thing is, after reading a few earlier replies. That since 'law' (Ya right!) allows online companies to make mistakes with no retributions, then mistakes like this will (HAS) become the norm.

    Say for example the 3 times I noticed MS Marketplace advertising a sale price of $4.99, but then when you click on the ad, the price is 3 times that. I posted about it. But then began noticing.. Such things are commonplace with MS, and I contend that since
    it is so commonplace, it can only be by either design, laziness, or sheer stupidity.

    My vote is it's done by design, with the designers knowing that they will get away with it every-time.

    @Farscape, I work in retail and we don't have to honour an incorrect price ticket. (Although we usually do. Customer service and all that). Its called "Refusal to treat". Granted we would have to remove all the stock of the item from sale for 48 hours but
    thats the legal standing in the UK.

    It's one thing to revoke a license if you paid for the game. Say, the mistake had been that it was priced at €20 instead of the usual, you paid the 20 and now they'd revoke the license and give you your money back. In a case like that, at least here you'd
    have some rights. However, you paid nothing for it and in exchange for having your license revoked you get 10 bucks. Just take the money and be happy about it. It's a $10 profit for you for MS's mistake. People these days, smh.

    Nobody is perfect. And we are dealing with complex systems. It could very well be that there was a pricing change on something totally different and some kind of system error caused the problem. So in instances like this I have no problem with what they
    have done. And it is a nice thing to give the $10 instead of just removing the license and fixing the price error.

    Then again, I have seen this happen on physical items. Even at the grocery store. They had an advertisement of a price that was way low. Come to find out that the place that prints and sends the adds had an error. No way they could honor it. Most understood
    a mistake but a few where very upset. I had a friend who is like that and was very upset. Same friend would not honor his mistake when it happened in his store because it was priced by mistake due to getting busy and accidently mislabeling the item.

    And MS may be huge but they have to have consistency. So say they let this one slide. Then it happens again at some point in the future. They would be expected to honor it. And it could be a much larger number of people and cost a lot more money. And
    all from an input error that happened to mess with a game they did not expect and thus did not check for correctness.
