Not allowed to change xbox profile picture after a past temporary suspension.

A few months ago, I got temporarily suspended from xbox live. A few weeks later (been playing with xbox live), I decided to change my xbox profile picture. The problem was, every time I would go a try to change the picture it would decline my request.
I then went and looked at some online discussions to try and fond people in my own situation. I noticed that you could submit a case review to help solve the problem, but that was only for people who eligible. In my case, I was not. So I am
very confused on what to do to try and be able to change my xbox profile picture.
