No legal sale of accounts games?

It is against the ToU and CoC of the Live service to buy or sell accounts or video games from accounts and could result in both the account and/or console being permanently banned from the Live service.

If you're in the US, that's just Sales Tax. It's a legal requirement that it be applied.

As was stated previously, Sega, the publisher of the game you want, must offer the game for sale in your region. Microsoft can request it, but if Sega has reasons (legal or otherwise) to not sell the game in your region, there's nothing more they can do.

Yeah, you can't really argue that used game sales don't affect profits in some way, this has been a big problem for music sales since the good old vinyl days, the discs do say that "Resale IS Prohibited" but that didn't stop some from exploiting legal loopholes
to resell them anyway, it's not the launch day sales that are affected as much as the sales coming from new copies being sold a few months down the road at a reduced price...
