That error usually pops up if you have not got an official Xbox 360 hard drive installed in your console. Make sure you do have one, other wise the game will not work, due to the hard drive having the relevant emulator files for the game to work.

Hi, Xbox 360 games do not require an active Gold account to play. So, if your Gold subscription expires you will still be able to download Xbox 360 games that you have previously downloaded.

Only Xbox 360 games that is part of the Games with Gold will be playable after Gold expires.

Xbox one titles will need an active gold subscription to be able to play them.

For xbox one games with gold you need an active gold subscription. Without that you are not able to play the games. The games with gold for the 360 are not need gold to play them after your subscription runs out.
