Live account banned permanently for no reason, HELP please!

My 10 year old son's account was banned Christmas Eve (was so much fun watching a kid open new games that he couldn't play)! This is the email I received Christmas Eve:
This email is to notify you that your Xbox LIVE account privileges have been permanently suspended due to modification of your gamertag or other profile data.

These modifications may include, but are not limited to:
•Altering the appearance of your gamertag or avatar
•Illegitimate gain of achievements or avatar awards
•Application of watermarks or other special identifiers that were not legitimately granted
    •Unauthorized manipulation of in-game parameters

Your conduct was brought to the attention of the LIVE Enforcement Team through complaints filed by other Xbox LIVE users or in the course of our operation of the service. The LIVE Enforcement Team has reviewed the complaints and other evidence regarding your conduct and determined it violates the Xbox LIVE Terms of Use and/or Code of Conduct. Because your conduct is in violation, the LIVE Enforcement Team has issued a permanent suspension.

During your suspension, you will not be able to log into Xbox LIVE. Your Xbox LIVE privileges will not be reinstated.

Customer Support is not able to modify or provide any further details about your suspension.

My son does not know how to modify or alter any of these things, so the ban is not legitimate, but the account is suspended. I spent 4 hours on Christmas Day trying to get this straightened out, and was told it was a billing problem so I was transferred to billing which never answered. Today I called support again, and made the customer care person look into the account in depth and she said it had nothing to do with billing, that I was on auto pay with paypal and that it was received. She helped me set up a temporary account and transferred me to billing to change over my payment details from banned account. (Still on hold to India right now after almost an hour).
She was unable to tell me whether points that we have purchased or games, etc would be transferred.

I want to know how to get this straightened out because my son has logged many hours playing his games, gaining points, added purchased points, etc. to his account and now it is all gone. Like I said before, my son is not capable of doing the things the ban states, so I need help in resolving this, because either someone hacked his account, or he was unfairly targeted by gamers in rooms.

Thank you in advance for any help or advice you can offer!

My son's banned gamer tag is Gunman708
his new gamer tag is SnowingSpy44

  3. Legal mods/mod menus for mw2?

No mods of any kind are allowed on any game on Xbox Live. If your son uses them he will be at risk of having his xbox console and account permanently banned from using Xbox Live.

My son was banned permanently because of an attack on his account!!!!!!!!!

If you suspect his account was compromised, you would need to contact support and have them start an unauthorized access investigation. 1-800-4my-xbox if you're in the US/Canada or
Xbox One Support | Xbox 360 Support | Xbox Live and Billing Support If you know who did it, you would need to file a complaint on them via the console in order for the enforcement team to investigate them.

To see about submitting a case review on his ban, you would need to go to http://enforcement.xbox.com

  6. Just because a bunch of people report you does not mean that the enforcement team is going to suspend an account every report that is made is investigated by someone and if there was a violation of the code of conduct that is when a suspension is put on
    an account.

A copy of the code of conduct can be found here Microsoft’s Code of Conduct Explained for Xbox Live Customers

Keep in mind that it does not matter who started a conversation or how it progressed if there was a violation of the code of conduct even if it was in retaliation to what someone else said the account would be subject to a suspension.

  9. You would have to go to the enforcement teams website enforcment.xbox.com sign into your sons account if it is an adult account or sign into the parent account if it is considered a child account click on the orange hammer that is there on the main page
which will take you to the enforcement history and where it shows the current enforcement action there will be an option to file for a case review it will ask you a series of questions about the code of conduct (you do have to answer all of them correctly
in order to qualify for a case review) at which point you will be given an opportunity to plead your case to the enforcement team who will then reinvestigate the report and determine if they can lift the suspension sooner.

This is the only way to get the suspension lifted sooner.

  11. Another thing when you say an attack happened on his account.

Do you mean someone stole his sign in information and started doing stuff that would be against the code of conduct?

Did your son possibly give his account information to someone and they signed into his account and did stuff that shouldn't have been done?

We need more information on what you mean by your sons account was attacked?

And how do you know it was a permanent suspension? To find out for sure when you go to the enforcement site and look at the enforcement history for the account it should tell you how long the current suspension is for should have an end date if the end date
on it shows 12/31/9999 then yes it is a permanent suspension but if it shows less time then it would only be a temporary suspension.

If it is a permanent suspension those are not taken lightly their had to be something that was very egregious for them to do a permanent suspension.

  13. My son was banned permanently because of an attack on his account!!!!!!!!!

So in a case like this you would need to contact Xbox support and inform them that your sons account was compromised and the people that got onto the account then did things to violate the code of conduct and got your sons account permanently banned they
would then fill out a form and do an investigation to determine if the account was truly compromised and part of the form is having you start a new Microsoft account and if they determine that the account was truly compromised then they will transfer all of
your information over to the new account that they have you create.

  15. Hi there,

Permanent bans occur when there are multiple infractions over a long period of time. Permanent bans are indeed permanent and there is a loss of everything connected with that account. This cannot be appealed and cannot be reversed. Every user is responsible
for their accounts and if an account was hacked and bad language was used, that would not be enough for a permanent ban. It's a very serious and irreversible step we take to ensure the safety of our other users. We thank you for reaching out to us with this
issue, but enforcement has the final say on these matters.
