    No one can just "take your account" if you haven't given them your data in the first place. Anyway you just have to change your account's password and they will not be able to use it anymore.

    If you have already used the 5 allotted home Xbox changes with in the past 12 months you will have to wait. You can try contacting official support but there's no guarantee they will be able to assist you.
