Money back or Playtime

I paid for XBOX LIve Gold 12 months to use it. Now I`m banned from using XBOX Live for a second time. I cant use the service for nearly one month. I want my money back for this time or the time I lost to play.

You banned me for communication I do.

In Germany you cant steal me something without giving raplacement if I pay for a service. I paid to use XBOX LIve Gold for 12 month. because you ban me from using it I can use it only for 11 months.

I havent a problem that I cant communicate with other players but that I cant Online-Playing which I paid for is a big problem and not compatible with german law.

I've never been one to embrace the entitlement society notion not have I ever been fixated on what the other guy can do for me. I spent a large portion of my working career trying to stop folks like that via investigations.

 

You might want to read the ToU/CoC you agreed to when starting your account.

You are not entitled to any refund for lost gold subscription time due to enforcement action on your account.

That applies to everyone,no matter what country you live in.

 

This part is not legal. In Germany we have some specific rights.

If one part of contract break it the other part has the right to cancel the conract and the part who gets a payment have to refund the Things other part cant use the following time.

For example: If I pay for a Service over one year and after half year the other part give me only the half Service I paid for, I have to notice him that I miss some parts of Service. If he didnt help me and I cant use the Service as I paid for I can cancel
contract and get my Money back.

It is not important how I communicate with other Players. You can block my communication because this was my mistake. But if you block Multiplayer Feature which I paid for you didnt fullfill the contract. It would be another thing if I modify my console
and want to use Multiplayer but I didnt. I only used bad language if I write to other Players. Thats not a reason to cancel my Multiplayer for 2 weeks without a refund.

You agreed to the ToU/CoC when you started your account which is a legally binding contract.

Doesn't matter what country you live in & what laws you have,you legally agreed to abide by a set of rules when you started your account & you agreed that you are not eligible for a refund on any lost money if your account is suspended due to you violating
the ToU/CoC.

 

Thats wrong. Maybe I agreed to ToU/CoC but if it has parts not legal in a country I make the contract, the whole contract is not valid.

Thats the reason why Online Shops like Amazon have to make several ToU/CoC for different countries. Same applies to you.

For example: If I buy a console in germany I can get my money back within 14 days if Im not happy with the console. In other countries I cant give my console back because law has no rules for it.

You cant make a ToU/CoC which didnt matches the law in a country I used it. I have a microsoft germany account so you have to use german rules which matches german law. If you didnt the whole ToU/CoC is not valid in my country.
