Here is a quote from our Xbox 360 Public Beta Program Agreement, which you agreed too when signing up for the Beta.

"Pre-Release Software. You acknowledge that due to the unique nature of pre-release software update programs, there is a risk that this software update may impair your console’s functionality or even render it inoperable."

Also, here is a quote from the
Product warranty and software license you agreed to when you first turned on your Xbox 360 console.

"Any replacement parts or Xbox Product will be new or refurbished or serviceably used, comparable in function and performance to the original part or Xbox Product and warranted for the remainder of the original Warranty Period or 30 days from the date
of shipment of the Xbox Product back to you, whichever is longer."

Sorry, but there is nothing that can be done. Since there is no way to register a new console to the beta, you will have to either make purchases on someone else's console that does have the beta or wait until the update rolls out. This is why there are
so many warnings to read before you agree to the beta.

Oh cool its stil on my account but I can't use it until they roll out a new beta? That's $50 bucks I couldve used for gas, food, or anything else but guess I should feel better knowing that microsoft is just holding on to it eh? Ripoff!!! They're has to
be a way to for microsoft to do something, and explain this if the beta is not on my new xbox shouldn't I be able to use the points since this consoles not updated? Or is microsoft just gonna keep selling points and keep the money until they feel like converting
it. Why not not just selling points? I shouldn't have to wait, if it was your 50 bucks you wouldn't be say cool about it
