    Alright so I shall be quite frank and word this appropriately so as to frame the ideological problem as well as the unreasonable expectation.

    Initial Problem:

    -Banned from xbox communications for 14 days

    Reason:

    -sending Inappropriate messages or participating in inappropriate voice or text communications. This may include harassment or bullying behavior, using abusive or offensive language, negative speech towards a person or group, disruptive behavior, spamming,
    or other inappropriate behavior.

    Conflict in expectation:

    This is my third violation apparently in the last 3 years, (I read the new COC every time I'm cited to upon update to the COC) That said i have been put on a communications ban 3 times and each time over the last 3 years the offense has gotten a longer penalty...
    it NEVER resets.

    Whats so egregious about this expectation is that Microsoft expects every single scenario to be absolutely calm, especially when disputes arise. Now I am certainly not making the argument that some situations shouldn't be ignored or what have you. There
    is always a case to be made for being the bigger person when one side is upset for no real reason and the other side can just walk away knowing they did nothing wrong. I would be remiss to leave out however that there are situations that occur on the fly and
    we react as sentient human beings with anger and or frustration. That said there should be absolutely less strict policies regarding these sudden outburst of anger or frustration (specifically when there is not a consistent pattern of abuse). I would urge
    an immediate restructure of the current code of conduct policies to limit the length of the stack-able ban times, so as to avoid ridiculous lengths of time without in game communications for a slip up. Or at least a warning once or twice within a year so that
    these extended bans are expected when it does happen.

    Just for reference my last offense occurred January 27th 2018 and lasted till February 2nd 2018, so for an entire 365 days and beyond I was at least on decent behavior. That said i dont believe it is reasonable for there to be a 2 week ban on communications
    for the following quoted text which was the last offensive message sent through the Xbox system from me.

    "dude get the [Mod Removed-Profanity] off of apex man, you stole the gold shield and you cant even do
    [Mod Removed-Profanity] with it! get the [Mod Removed-Profanity] outta here man you are trash."

    Given the above quotation there was clearly some context to the situation that was clearly aggravated and made me hot-headed specifically because i play Apex in very competitive way. That said, there is absolutely no reason that this one time offense over
    the last year earned me a 2 week ban. It is unreasonable to stack bans a year apart given the complexities of human emotion. A warning to be on better behavior would have sufficed.

    Ideological framing:

    I have a considerable problem with the ideological inconsistencies here as well that i feel should be addressed so long as we are scrutinizing the initial policy that the remark above was prosecuted under.

    First of all the context of humanity playing any role in the above sentencing was removed entirely and instead of being treated like a human being and an adult, i was treated like a robot where the last years punishment was written into my code... it was
    not.

    Secondly, the scenario at play and the prosecution of such things make the mute and block features effectively meaningless and significantly limit my right to freedom of speech on a gaming platform that utilizes the internet to broadcast social gaming environments
    world wide. Accessing both public domains as well as private domains to do so.

    Thirdly Xbox wishes to create a safe environment while not respecting the ability for people to just utilize the ignore or block functions and are therefore forwarding the new social justice waves safe space and micro aggression accusations. Building an
    environment where you can be banned for utilizing slurs or curses when expressing ones frustration is really dangerous and has immediate and damaging effects to the overall gaming environment. That said if this stays the same as it is now forever you are going
    to notice an increase in the lack of communication over Xbox as a whole and it plays into the victim culture that the liberal/leftists wish to enforce on American and European people; further drowning out our voices.

    Conclusion:

    Not many people can admit that they didnt enjoy hoping on halo reach to get a healthy amount of aggression out whilst shooting some elites or other Spartans. The trash talk was fun and if it got out of hand there were back up methods for reporting it, however
    if it just got annoying you could always block and or mute that person in game or their profile.

    All the same i do NOT feel as though the comment i made from a bad in game situation deserves a 2 WEEK BAN from communications especially since it has been over 400 days since my last offense. I feel that this ban was entirely overboard and entirely unreasonable.

    What do you all think and what if this happened to you in a day and age where games show far worse than the content i displayed in a voice communication?

    Sorry to hear you are running into this enforcement action. Now I understand that you feel you should not have a 2 week suspension because you have not committed any offense in the past 400 days, unfortunately this is not the case. You should always be following
    the
    Code of Conduct
    no matter how long it has been since you last committed an offense.

    For more information on your suspension you can go ahead and visit the
    Enforcement Website
    . Once you have logged into your account and if you feel that you should not be suspended for this you can always submit a case review to the enforcement team.

    As far as the length of suspension goes depending on the infraction you could be permanently suspended on the first offense.

    As far as getting a warning when you agree to the code of conduct that is your warning.

    As far as freedom of speech goes lets look at the 1st amendment

    "Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the
    government for a redress of grievances."

    As I highlighted for you it says that congress shall make no laws abridging the freedom of speech.

    This means that a private company on private servers can make rules that you agree to follow on their servers.

    What a lot of people do not understand is that the Bill of Rights to the US constitution was put into place to protect the citizens against an overreaching government.

    As far as games showing worse content it is not up to MS to babysit the kids and make sure that they are not playing games that they are not supposed to be that is up to the parents whether they will allow their kids to play certain games MS just gives the
    parents the ability to block their kids access to certain games and online content if the parent chooses not to use that technology thats up to the parent.

    Well, it all depends on what the offense is.

    For abuse of services say cursing and getting reported, you should have 3 strikes.

    Strike 1 - Warning via message

    Strike 2 - Second Warning

    Strike 3 - Temp suspension 1-2days(Xbox LIve turned off)

    Strike 4 - Console Ban 1-2days ( No xbox use whatsoever )

    Then it just gets worse.

    For modding it should have 3 strikes but with more harsh enforcement depending on the type of mods.

    Strike 1 - Warning which would include something that says (Will obtain more strikes until elicit activity is gone which means they would be monitored.)

    Strike 2 - Suspension 3-4 Days

    Strike 3 - Console Ban 5-10 days

    Strike 4 - Permaban

    This would be a rough sketch on how I'd do it but it is different per offense.

"Expiration" denotes the precise period after which a strike is totally erased from your account history and no longer influences your total strike count, while "end" indicates when a strike no longer counts toward possible account restrictions. If you don't have other strikes, you may be able to message and join parties again after the "end" period.
