You do you mean marketplace theft? I never modified my xbox, it hasn't been opened ever since I bought it. I don't buy anything on the marketplace unless I have the points. What is going on?

Yes it is a bannable offence,as Farscape said,it would be classed as marketplace theft & could also mean you may lose access to other digital items you have bought

I wouldn't do it, theres been many people banned for Marketplace Theft/accessing Xbox LIVE marketplace download content through illegitimate means.

While the content could be legitimate, creating two copies for seperate accounts on seperate consoles can result in a break of the ToU/CoC.
