Does anyone know if there is a list of xbox 360 games that are backwards compatible and are sold retail in xbox one cases?

Xbox 360 games on One without 360

If the games are backward compatible (in this case Fallout 3 is), then yes you can play the game on an Xbox One. You do not need an Xbox 360 to play it. The full list of backward compatible games can be found here Xbox One Backward Compatibility | Xbox

Is there a way to get the Xbox 360 games without having an Xbox 360 in case they get added to the backwards compatibility list?

 

None of the backwards compatible games would be sold in Xbox One cases. They would be in 360 cases.

There is a list of available games here at
Backward compatible list. As for them being disk you would have to check game stores or any other third party retailer. If you get from Xbox or Microsoft stores they will be digital copies.

I actually have seen a handful of games sold at retail stores that are indeed in Xbox One-type packaging (not the DVD-style Xbox 360 cases) that indicate they run on both. While this is not a comprehensive list (and I don't know where one might be), here
are the ones I have seen in stores myself:

Elder Scrolls IV: Oblivion

Grand Theft Auto IV

Red Dead Redemption

I have about 15 of them. A few are sold in the larger 360 cases and more are sold in the xbox one cases. They say Xbox 360 xbox one on the top front of the case in raised white lettering. the 360 cased games just say it on the top front of the paper cover
insert. And a few are in thin green cases that also xbox 360 xbox one and have codesinside for digital download. search xbox 360 xbox one on ebay to see them.

Cool, but why is Oblivion in a box with both Xbox One and 360 on the front? The 360 version of Skyrim isn't BC. Are they selling both versions in the same box?

 

Skyrim isn't backwards compatible, but Oblivion is.

 

Because the Xbox 360 version of Oblivion is back-compatible on Xbox One. A remastered version of Skyrim was released on Xbox One, but the Xbox 360 version of the game is not on back-compat at this time.
