quick question.

brother got some dlc for a game the other day if i license transfer it over to my account to play on my account name instead of his would that be bannable?

This. It's $5 a month or $30 for a year and you get BF4 plus other EA games and discounts on their digital content.

you guys sharing the same xbox? you could have him take ownership of both consoles, if it is two different ones than his licence would be on both, I had a Xbox 360 an a Xbox one an My DLC from the 360 carried over, only thing that was useful was my premium

Licence transfer can not move content from one account to another. Once content is purchased on an account, it will always belong to that account. A licence transfer works is used when you want to move all of your downloaded

There is a way that you are able to access any of your brother's downloaded content, which isn't against the rules, or considered "Marketplace theft". Simply sign your own account into the same console as his. Downloaded content
comes with two content licences. One for the account (in this case, your brother's account), and one for the console it was originally purchased for.

The "account" licence means that your brother can sign onto any Xbox console he wants to, then play his downloaded content from there. The catch here is that your brothers account must be signed in before any other account can
access his DLC.

The "console" license means that any account that is on the console where the DLC was purchased can access that DLC from that console any time you want. The catch here is that if your account didn't purchase it, then you won't
have access to it on other consoles.

If you and your brother use the same console, you can already use your brother's DLC. If you use different consoles, you will need to buy the DLC yourself.

Basically, what Zen wrote. Sign in on your brother's Xbox and you should be good to go.

The licenses are tied to the console so using the same hard drive would not transfer the licenses and licenses cannot be transferred via transfer cable. The only way to transfer licenses is through a licence transfer over Live.
