For those still checking this thread for new information then I'm happy to say that I've used the latest update and the problem now appears to be resolved.

we unplugged the internet and emptied the cache like we were told and it is working

Having read your suggestions I've cleared my system cache. Update removed and the game is runnig. It asked me to update and I refused, so I'm disconnected from xbox live, but I'll keep checking forum to see if the update i fixed.
