Legality of downloading games with gold titles early?

This comes up in conversation everytime a new Games With Gold title comes out, and I'm finally asking about it. New GwG titles are set to their free pricepoint usually at least a half day in advance of their targeted release date. Despite this, it's usually
more then 24 hours later before the ad updates to refelct the new GwG being available. Is it permissable and valid to download it free, before the 16th/ad update? Invariably this issue causes arguments between people who say it will get you banned, or won't...
And I'd like to confirm or deny once and for all.

We know some people were having some difficulty downloading Evolve this weekend. Are you still having trouble or were you able to sort it all out and get your game?

Games with gold title not downloading

i came on today and i went to see what the new gold game was which was Evolve but when i pressed the 'get' button and it went to my queue. i went on and checked the progress but all of the items were on queue even after i 'installed now' it still didnt work.
can anyone help me?

as long as its available for purchase and you buy it its legal no matter what the price says as long as you did not try to modify any detail of the purchase. in other words No its not bannable or illegal

Since one year early , you don't change the région for store or game with gold, it is not legal. Have a nice day

Game "backups" are a legal grey area. Closest thing to the 360, is installing games. I'm not sure if the Xbox One supports installing games, but, backwards compatible 360 titles, are downloaded to your console, and need the disc to just boot up the title.

I'm sure it is all about license contract agreements. Anything you get from marketplace, Microsoft has to pay to the respective gaming companies that owns the rights to the games. I'm sure the Games with Gold and Deals with Gold are based on their negotiation
agreements with the other companies. Same reason why some games are not available for Digital Download, no agreement to licensing contracts.

Agree with early post about some type of credit should be given to allow another game title if you purchased the free game previously. Like 4 credits for 1 game title.
