unfortunately in this situation you are responsible for anyone using your account. if you or anybody else break the t&c of the xbox live user policy your account will be suspended.

 

You will, in all likelihood, be denied in a case review against your suspension for this. You are responsible for anyone using your console and their behaviour. Case reviews are meant for those banned for reasons that don't break the terms of service.
