    The latest game the account has played was gears of war 3 (360 game) the account doesn't have any Xbox one games in there backlog and from what i can see the account has not been active for a long while.

    In short, no.

    Just because a gamertag doesn't appear active (ie not playing games) does not mean that it is not being used elsewhere for a non-gaming purpose (for example, a forum I use logs in using my gamertag). Unless the gamertag is listed as available if you try to change gamertag, then it's not accessible

    Getting my old Gamertag back.

    If an account already has your gamertag then you will not be able to get it back. Even if the account is not being used and it has a silver membership your old gamertag will be unavailable as long as that account exists.

    Another possibility is the gamertag might be frozen by microsoft, you might want to contact them if you are 100% sure that there is no other account using the gamertag.

    If the tag doesn't log in for 5 years then it's made available.

    As ngocphi said,gamertags are used on other services,not just xbox live so you can't know whether the tag is being used or not.

    It isn't an on demand service nor does it have to be an Xbox account to be active

    It just has to be active some people have forums accounts or Skype or Xbox games for Windows or apps for Windows which case you don't need achievements just purchases
