I'm sorry, but since you gave so much information, I'm having troubles determining what the actual problem is here. So she has a Microsoft account that you guys tried creating an Xbox Live account with and it didn't work? And you were trying to create the
Xbox Live profile so that she could use the Surface with the same Microsoft account and have her Xbox Games on there? I am just verifying to make sure I understand the issue at hand.

This sounds like you have a child Xbox Live account and need parental permissions to enable your account on a new system.

OR

The previous Xbox owner has/had parental controls enabled on their system and needs to be
removed before enabling your account. Please contact the previous owner to remove their account from the system you purchased.

The Xbox system itself also has a parental control feature in the settings of the console. No account needed to enable this feature.

if you create a microsoft account and yo sing in on the page xbox.com when you sing in they create a gamertag if you later try to use that same microsoft account to create a new gamertag on the xbox you cant because you have one already when you sing in
on the xbox live page.
