If profile banned, do you lose access to your digital copies?

Not sure if this is the right thread. Be on on 360 or One, your fault or not, when you are profile banned to you lose licence rights or access to said games on the account that banned? There was a Reddit interview with Major Nelson and he said you absolutely
do not lose access, but I believe it was in response to the Xbox One, not any digital games on your 360.

Of course since they're downloaded to your Xbox you can play them on any account, but what if I switch Xbox's and can't licence them off of my banned account? Doesn't that mean the games you bought you don't actually own? Anyway, I just want someone to confirm: hen

What worries me the most is losing access to my digital copies, what happens if you spend thousands of your hard earned income over 5 years, and lose access to your profile via cyber theft, rightly or un rightly being banned. As current terms stand, if your
suspended, your digital right are also suspended.

We all saw what happened to Sony members a few years back losing their personal details. Is XBL/Microsoft any safer? Are Microsoft & Sony going to beef up their security systems. Will their be an improved appeal system added for suspended accounts. You can
appeal on these forums but I've never seen anyone win their account access back.

the only people that can assist you are in the enforcement forums, the post will not go live straight away as they have to approve them, if the console has been banned but not your profile then you have not lost anything, if your profile has been banned
then you lose everything, im not judging as i don't know what you might have done but they don't ban for no good reasons, when you open the xbox and make a profile you are agreeing to there terms of use and if banned will lose access to all licences for the
content purchased as we don't own any games.

 

yes if it is a perm ban you forfeit them as long as you keep them on your system you can still use them but if you delete them the only way to get them again is if you buy them again on a different non banned account.

 

Why did Major Nelson say you do not lose the licence?

 

dunno but when you buy or download a game you get that license and the ability to get it back if you delete it but if you get banned that license is revoked and you cannot get it back so as long as you do not delete downloaded content and games you will
be fine.

 

He did indeed say (for the Xbox One) that you would not lose access to the games you'd purchased, and that you wouldn't be able to play the Multiplayer. This does seem to be different to the current policy of losing all of the items that you've purchased.
Admittedly, the games still work on the console for others, just not your banned profile, as I understand it, on the 360.

Thanks Hyrule. I think they should fix this to be like the Xbox One... When he said, "OH, ABSOLUTELY NOT!" As if he was shocked they had asked that question but that's exactly how it is on the 360, lol... Basically the games you pay for digitally you don't
even own if they can just take it away, it's pretty much the same as coming into your house and taking all your hard copies imo. I'll be buying hard copies from now on! Thanks for the answers!

 

i found out the hard way today. my xbox one had a hdmi passthrough problem. nothing major. just a minor fix. i sent my console in to be "REPAIRED" and they sent me a brand new console. and since the enforcement team banned my main account. now all the
games i have had downloaded on my console are completely gone. this company is the worst ever. i can understand not being able to play online or chat but how can you just steal peoples money like this. i really dont even care about all the dlc its the
fact before i sent games in for repair i had two full hardrives of purchased content. and now i got a xbox one new console coming to me. and a 360 that is being repaired as well with that outcome to be determined as well. so i could be out 30 + games total
because they considered me harassing people that called me all types of names vulgar threatning in private messages.
