I was wrongfully banned because i believe i was mass spammed as a cheater

I was playing call of duty black ops and after destroying the other team i believe they thought we were hacking, me and my friend BEAST KID2253 were playing together and after the match i received a message on Xbox saying i have been banned from communications,
at first i thought it was a glitch and waited a day but it didn't change at all. I was wrongfully banned and i have video footage of the possible culprits of the mass spam. Please help me

Xbox Live Enforcement team. Any and all information can be found on their website. If the Policy and Enforcement Team has upheld their decision, at this point you will have to wait out your ban.

I believe I was wrongfully banned

So it all started about 7 months ago when me and my girlfriend met some guy and we added him cause he seemed pretty cool, as the days went on he kept bothering my girlfriend and trying to flirt with her and she asked him numerous times to stop but he wouldn't.
He would stalk her, spam her and harass her constantly. So she decided to block him, he then began making fake accounts to harass me and her and has cursed out many times and so on for no reason. He has been stalking and harassing us for months and after many
reports he has yet to be banned. Out of the many times Ive reported him, nothing has been done about him but the one time I call him a "creep" I get banned. I should not be banned for defending my girlfriend who is scared to do anything out of fear that this
guy will continue to harass her. Stalking is a federal offense Microsoft and you told me a very thorough investigation would be done but 10 minutes after I sent in my appeal you banned me.
