Under the section "What are examples of content that is prohibited in Xbox Live?"

One of the list states that "Content that promotes, or sounds
or looks like words, phrases, puns, images or imagery that refer to any prohibited content"

A violation of the Microsoft Code of Conduct may result to "Automatic assignment of a new Gamertag, if you create an inappropriate Gamertag."

You can try submitting a case review at
http://enforcement.xbox.com but if they uphold their decision, you can't have the tag back.

Why would it even be a bother you do realize that there are probably a million or more John's in the world

Tell us how they can pick you out of all of them

They can't

what moder forums tell you there is no free change because the said excuses can be solved

Not to mention it is a black mark on your gamer account record

also what they are advising isn't recommended because it is only used for terms of use violations

And you don't get to pick your name you are given a random one and have to pay for a personal name again

The name change isn't to reward people who break the rules it is to punish them

That gamertag is still active. It was used yesterday.
