Thank you for posting here on the Xbox forums. In short, then enforcement team that handles suspensions relies on Xbox users to report other players when they break the terms of use.

It is very possible that whoever you sent that message to, reported your message as inappropriate. At which point, the enforcement team would handle this incident and issue an enforcement action if one is warranted.

yes you can get banned for breaking the terms of use for opening it but i dont think there is a way they will know its been opened unless you hacked the console and my friend fixed the rrod and he is still using his xbox online today

you can report any gamertag for image and they are immediately suspended with a forced gamer pic change, others have also tested this and have the exact same result, have tested this myself on my old account and that was just a solid colour. the system is broken beyond belief and until it is sorted Microsoft cannot be trusted with anything.
