I have Xbox live on my account and I don't know why

Like the title says. Last night I was playing on a guest account in Minecraft and noticed that my account has Xbox live? Why is this? I didn't buy it, yet I was able to play online.

I don't know why

Perform a hard reset EXACTLY like this.

Hold the power button on the console for 8 seconds or until the power shuts down completely. Unplug the power cord from the back of the console for 5 minutes. Plug the power cord back in and restart the console.

I tried to message one of my friends in another account it kept saying failed to send messages

The account you're posting with is showing as Silver, not Gold. If you were using a Guest account and were playing with another tag on that console that had a Gold membership then that would be why the Guest account could play online.

Xbox Enforcement web site and if eligible you should be able to request a case review from here as well.

Well, this page covers account recovery but you still need to know the email address as that is the primary identifier of the account. Without the email, i don't believe there is anything they can do
