you can apply for the refund as the previous post says or you also have the option to call xbox support and speak with an xbox live agent to have them refund the money for the game, I have personally had to do this and they are very helpful and have access
to see that you have not downloaded the game or played it so they can process your refund. Either way the xbox support team will take care of you.

 

Contact customer support amd explain what happened they will take care of it!!
